Q: Hi, Last September I filed a case against my employer as he hasn’t given any of my settlement after my 2 years of service in their company. However, last November 2018 the court ruled in my favour, and up to date, I haven’t received any call from my previous company. Yet, I’m trying to file for execution but this typing centre keeps telling me to come back after a week which is illogical for me because it’s been 2 months since I received the court decision. By this time, I should've already received the settlement. What advice can you share with me to make the process faster as I’m planning to return to my home country? Thank you in advance

س: السلام عليكم، من فضلك لدي استفسار. صدر حكم نهائي من المحكمة بمستحقات عمالية لي منذ يوليو 2020 ومنذ ذلك الحين تقدمت بإجراءات التنفيذ ولكن لا يوجد أي تقدُّم ولم أتحصل على أي جزء من أموالي المستحقة. القاضية رفضت قرار الضبط والإحضار لمدير الشركة ورفضت أيضًا قرار منعه من السفر. مر أكثر من عام الآن والمستحقات مستحقة منذ 2017 وصاحب الشركة مستقر في دبي ولديه شركة أخرى. محكمة التنفيذ ترفض اتخاذ أي إجراءات لتحصيل أموالي. ما الذي يمكن عمله من إجراءات تنفيذ لتحصيل مستحقاتي.

س: شركة ذ.م.م تم حجز حساباتها البنكية وتدعي عدم امتلاكها لأموال لتنفيذ حكم دعوى عمالية ضدها وتقدم تقارير حسابية بذلك. ولكن عند التقصي وجد أنها خاطبت عملاءها والمتعاقدين معها (مثبت بصور خطاباتها) بالسداد لها عن طريق حسابات بنكية لشركات أخرى (وسيطة). هل يمكن مقاضاة مدير الشركة والشريك في مالهم الخاص دون ذمة الشركة المالية؟

س: السلام عليكم، الاستفسار عن حكم عمالي داخل دولة الإمارات. رفعت شكوى عمالية من شهر ٨/٢٠٢١ وصدر حكم لصالحي بمستحقات ٨ أشهر بدون راتب. تم الاستئناف على الحكم وبعد ذلك صدر حكم آخر لصالحي بنفس المبلغ. فتحت ملف تنفيذي بالفعل وصدرت الخطابات بالحجز على الأموال والمركبات وغيرها وذلك في شهر ١٠/٢٠٢١. بعد طول فترة عدم تحصيلي المبالغ المستحقة لدى الشركة، أرسلت مخاطبة ضبط وإحضار لمدير الشركة وحتى الآن أيضًا لم أحصل على مستحقاتي مما ترتب عليه كثره الديون. ماذا أفعل لتسريع التنفيذ وتحصيل مستحقاتي أم ضاع رزق بناتي؟ علمًا بأن الحكم صدر بمبلغ ٥٤٠٠٠ درهم. الرجاء الإفادة!

س: السلام عليكم، تقدمت بشكوى عمالية وتم إحالتها للقضاء. صدر الحكم فيها حكمًا قطعيًا لصالحي خاصة أن مبلغ المستحقات أقل من النصاب القانوني. أولاً: ما المدة التي يتوجب علي انتظارها لإيداع الحكم بالتنفيذ؟ علمًا بأن الحكم قطعي بتاريخ 20-09-2022؟ ثانيًا: ما الإجراء المطلوب للالتحاق بمكان عمل جديد (عمل إقامة جديدة)؟

The UAE has adopted a major reform in its legislative system that brought about 40 new laws and amendments to the company law, criminal law, personal status, among others. The amendments aim to develop the legislative structure in various sectors, the labor law being one of these, was the most recent. We try in this article to shed light on the changes introduced with the new labor law and their significance on both, the employer and employee.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

The law promulgates UAE Civil Procedures Code (Civil Procedure Law) which governs civil procedures in the United Arab Emirates, including the prosecution before the courts, litigation and execution.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
