Imposing a labor ban due to terminating an unlimited contract by an employee
Respected Sir/Madam,
I am working in an Ajman mainland firm with an unlimited contract for 1 year. I got an offer from another employer for the same position with a higher salary.
My present contract stated that I have a probation period of 3 months. My questions are:
1) Will my employer be able to impose a labour ban if I do not fulfil the notice period of 3 months?
2) If I fulfil my 3 months notice period, is there any way that my present employer can prevent me from joining a new job?

Dear questioner,
Since you are on an unlimited contract, I would recommend you complete your probation period and then serve a notice period as required by the employment contract.
As per a resolution passed in 2016, terminating an employment contract during probation after completing the required notice period or other terms (mutually agreed upon with the employer), without a labor ban is based on mutual agreement with the employer only.
This facility depends on your skill level as defined by labor law.
Skill levels 1 (under-graduate degree or higher), 2 (diplomas in any field) and 3 (higher-secondary or high-school) can make use of this clause to avoid a ban.
