Q: My tenancy contract specifies that "In the event of early termination, Tenant shall have to serve two-month written notice prior to the vacating date and to pay two months rent as a penalty to the landlord and the remaining balance to be refunded".
Based on that, please advise if during the two months notice I can stay in the property and paying those two months rent (which are effectively already paid) are the penalty or if after the two months notice an additional two months rent should be paid as a penalty?

Q: I have served notice on my rental property in Dubai. The early termination clause states that I must give 30 days notice and pay 2 months penalty rent.
Is the 2 months penalty consecutive to the notice period or is it concurrent with it?
Appreciate any advice.

Q: Hi,
We just received our eviction notice from our Landlord for next summer 2018. We, however, would prefer exiting earlier.
In our current lease contract, we have the following clause: "The Parties agree that there may be instances where the tenant shall need to terminate the lease early. In this event, and in accordance with the current guidelines, the tenant must provide the landlord with a written 2 months of notice. The landlord agrees to refund any outstanding rental amount."
Kindly can you confirm the below:
This means that we still get to stay in the house for the 2 month notice period and there is no penalty charge.
The date on the letter is the 1st day of the 2 month notice period (notice given 23.08.2017, out by 22.10.2017).
Do we need the written notice to be notarized or does an emailed letter suffice?

Return of security deposit and rent dues

Q: Hi.
My daughter had stayed at an apartment 807, Marina Diamond 2 in Dubai from 1st May 2017 to 31st July 2018 on the lease of Mr Alex Hejazi's US national apartment.
The first contract was for one year and then extended for six months. The original contract had two months notice clause and renewed one with one month notice.
He was given a month's notice as per the tenancy agreement on 25th June 2018 by mail and over the phone and vacated on 31st July 2018. Returned to India on 8th August 2018.
The landlord is now not responding to mails or texts and has not returned any money. The dues are three months' rent and the security deposit total of AED 15600.
Now, she is back in India and cannot travel to lodge a case in RDC. How do I get back my hard-earned money without travelling to Dubai?

Settlement with the landlord for early termination of tenancy

Q: A housing agreement has been made for two years and post-dated cheques were also given.
Unfortunately, my husband lost his job, so he went and informed the house owner we want to cancel the agreement. But he is asking us to pay for the coming up three months rent.
If we lost the job also and three months rent, how is it possible?
Can you please guide me?

Q: Hello,
I'm the landlord of a flat in Dubai. I have rent out it to a tenant from 01/08/2019 to 31/07/2020.
The tenant has paid all with 2 checks. On 05, February, he told me that he wants to early terminate the contract and leave the flat on 05, April. In our addendum, it is written that:
18. In the event of termination of contract prior to the mentioned date of expiry, the tenant will have to inform the landlord with a 60 days prior written notice and indemnify the landlord with an amount equivalent of 2-month rent.
I understand that for sure he has to pay normal rent until 05, April and after that, he has to indemnify me with an amount like 2 months of penalty.
He understands that he has not to pay a penalty. Only stay until 5, April and leave.
What do you think about this?
In my opinion, "indemnify" means that he has to pay a penalty for my loss (the flat is empty, etc).

The landlord right to keep security deposit for early exit from tenancy

Q: I closed a rent contract with my new tenant on 7 December and after 2 weeks she changed her mind and asked me to refund her the security deposit.
She broke the contract and she is threatening me that she is going to make a complaint to RERA. She said that she couldn't open the Ejari even though I provided her with all the necessary documents.
I am not living in Dubai and couldn't do it in my person. So I would like to know if I am entitled to any compensation because she broke the contract?
I refuse to give her the security deposit which was even not fully paid (only 3k). I lost the rent for a month and refused other clients as I already had a contract signed.

Do I owe 4 months' rent if I terminate my lease without 60 days' notice?

Q: Dear Lawyers,
In the event of termination of the contract prior to the mentioned date of expiry, the Tenant will have to inform the Landlord with a written notice of 60 days in advance and indemnify the Landlord with an amount equivalent to 2 months' rent.
So, does this mean if I do not give 60 days' notice and want to move out immediately, I need to pay 4 months' rent?

Can a landlord evict a tenant based on an email, even if the official notice was served afterward? 0

Good day!
My landlord has sent me an eviction notice, which I received on 14 August 2024. The reasons are:
- For personal use or close relatives.
- For sale.
Now, my landlord is pressuring me to move out at the end of my contract on 30 April 2025. I am aware that the eviction notice must be served 12 months before the eviction date. In this case, the vacating date must be 14 August 2025.
For context: last year, three months before my tenancy renewal, my landlord sent me an email informing me that I had to move out on 30 April 2024. I objected, as there was no official 12-month eviction notice served through a notary public or registered mail.
Based on this, I renewed my contract at RDC for another year on the same terms.
Today, the landlord is telling me that because he informed me of his intention through email more than a year ago, he can now evict me at the end of this contract, on 30 April 2025, and not wait until the legal notice period ends on 14 August 2025.
What are my rights?
