Q: I had been working for an LLC company in Dubai for 6+ years on an unlimited contract and got terminated due to company restructuring.
I had signed my labour cancellation papers as they promised me that they will settle the amount at the earliest and currently working for a different company.
My termination happened in Nov 2016 and I had received half the amount of my end of service benefits in instalments.
I have not received the rest and they are not replying to my emails and they are telling me they will return for sure once the company is in good shape.
Please let me know if I still have a chance to get my end of service benefits.

Claiming labor entitlements after signing the cancellation paper

Q: I work for a company in IMPZ Dubai. I resigned on June 23 & my last working day was on July 22, 2018. My employer has not paid 2 months' salary & gratuity till date.
The company forcefully asked me to sign the cancellation paper and my visa got cancelled on August 16.
I have an email from the vice president of the company dated August 24 confirming that my settlements will be paid soon, and they mentioned in my settlement calculation that my dues will be paid upon visa cancellation, as this is their company policy.
Few other employees have left the company recently & the management followed the same process. i.e. visa cancellation first and then settlement of dues.
Kindly advise, how can I get my rights?

Is it possible to claim the EOSB after signing the cancellation paper?

Q: Hi,
I am working for a company in Dubai that has a trade license registered both under the mainland and in the free zone.
My work permit was under free zone for the last 06 years and now they have requested me to cancel the free zone visa and get the new work permit under the mainland.
They have forwarded me a document from Tecom to proceed with the cancellation, stating that I have received all my dues as part of gratuity.
However, the mitigation company has given a service continuation letter stating this is just an internal process and I have not received my dues.
Is this enough to protect me legally from any dispute that may occur in the future, or do I need to ask them for a notary attestation of the outstanding dues to get more protection from a legal perspective?
Kindly advise.

How to cancel the visa to get a job offer while labor dues are pending?

Q: Hello Sir,
I have been working in a company for 17 years and lost my job in July 2021. My visa is till Dec 2021. Till now, I have not received my settlement. I am getting only promises that it will be settled shortly. I haven't canceled my visa yet.
Last four months, I am somehow surviving with my family. Last week, I have got a job offer, but if I cancel my visa in my previous company, I am signing that I have received all my dues.
Please advise, what can be done?
a) Even if I sign that I have received my dues, and cancel my visa, can I legally claim my settlement?
b) If I don't cancel my visa before by expiry of the visa, what happens?
c) My family visa is on me and their visa is till June 2022. Will it affect them?
d) If I have to travel to India for an emergency, can I come back?

I submitted my resignation and I'm about to complete 30 days' notice period (I work under an unlimited contract).
My management is not ready to relieve me and will not cancel my visa. What can I do?

Q: Good day Sir,
I just received a work permit cancellation from our office.
It is written there that I CERTIFY THAT I HAVE RECEIVED ALL MY DUES UP TO DATE, but I didn't receive any single dirham. They need to transfer me to another visa but work for the same company.
I have been working for 8 years from the date I joined the company on 26 Feb. 2014. They are telling me to sign without receiving dues from my years of service 8 years.
Can you help me with this matter?

I am a medical practitioner and the center I am working at currently has my license. They have pending salaries to be paid to staff and we, the staff, have resigned.
I just want to know if we get the labor cancellation certificate now, are we still eligible to complain to labor for our pending salaries?

How can I get my labor dues from my company after filing a labor case?

Q: Hi
I put a case on my company and I have a hearing where the judge will be asking for evidence of the amount that I claim which is the final settlement paper.
The company did not give me that final settlement paper. If I have that paper with the amount mentioned on that, I can get my money. But the company is not giving it to me.
How can I get that paper whats my rights?
Please guide me.
