The witnesses of an inheritance case

Hi Rajasree,

Wishing you a good day!

In regards to inheritance cases, for the witnesses, does it only need to be male witnesses?

Can these witnesses be of any nationality?

Do they need to be related to the person registering the case?

Thank you in advance!

Sincerely,

Dear questioner,

It is not necessary that you shall present male witnesses only. If they are males, only two are required whereas if the witnesses are females, 4 are required.

The purpose of recording the witness statement is to make sure that the applicant is related to the deceased and all other heirs mentioned in the petition are related to the deceased and no one is excluded while enumerating the heirs before the court.

The witnesses shall be able to testify the relationship of the applicant(s) with the deceased.

It can be any of the deceased friends. or colleagues or neighbors or anyone of any nationality.

Regards,

Rajasree Ravivarma

Incorrect information.

Al Adheed was adamant that we need to take 2 Muslim witnesses as well as emphasizing that witnesses cannot be women.

Given then Al Adheed is sharing this information, I am just not clear who actually is providing guidance to all the different government and legal agencies here.
