كيف يتم نقل ملكية أصول غير المسلم في حالةٍ وفاته بعد صياغة وصية؟

بصفتي غير مسلم، إذا سجلت وصية في دولة الإمارات وإذا كنت أمتلك عقارًا هناك ولديّ أطفال قاصرون، ماذا الذي سيحدث لهذه الأصول إذا قمت بإضافة أسماء أطفالي القُصر بصفتهم مستفيدين؟

هل سيتم نقل ملكية الأصول إلى أطفالي القُصر؟

في أي عمر يمكنهم بيعها؟

هل يجب على منفذ الوصية الاحتفاظ بالممتلكات حتى يصبح الأطفال القاصرون بالغين؟

أم هل يستطيع الوصي بيعها لشخصٍ قاصر وتحويل الأموال إليه؟

Dear questioner,

I am a will draftsman, registered with the DIFC, and I can reply to all your questions.

Therefore, if you name your minor children as beneficiaries, you must appoint a trustee who can manage the assets until he/she reaches the age of majority (in the UAE- the age of majority is 21 years).

Your children will be able to sell the assets starting from the age of 21 or any other age mentioned by you in the will.

Eg: We have clients who had specific desires regarding the age of minors, therefore, they thought that their children are not mature enough at the age of 21, therefore, they mentioned in the will, that the children will be able to take over the assets once they reach another age, for example, 25.

Until that age, you can mention that your children can have monthly/yearly (as per your suggestion) a certain percentage of the outcome of the assets you own in the UAE or a fixed amount from your bank account(s).

If the executor is not appointed as trustee of the minor shares, he will not have any rights over the properties/assets and he will not be able to manage them.

Nobody is allowed to sell the properties, only your children after they reach the age of majority or the age mentioned by you in the will (which cannot be less than 21).

Yes,

The assets will be transferred to the minor child but take care, it will be done by the guardian.

The majority age is 21 years in the UAE law, therefore, after that, the minor can sell the property.
