Questions & Answers
How to claim the share of a jointly owned property from husband after selling it?
My husband and I jointly (50/50) own a property in Egypt. We agreed to sell the property.
My husband said that money had to be first transferred to an Egyptian bank and as I do not have this, we agreed that funds would be transferred to him and then he would transfer them to UAE and give me my 50% share.
He is now refusing to do this. Do I have a legal claim?

Dear questioner,
Yes, you do have a legal claim, but if you do not have documents to prove the abovesaid agreement between you and your husband, then you need to prove the agreement by other means such as making your husband take the oath.

Dear questioner,
Were the property papers jointly in both of your names?
If yes, you do have a right to receive 50 percent of the sale price.
What your husband did amounts to cheating and breach of trust.

Hello,
As per your query, please note that you are fully entitled to the property. Did you file for the divorce in UAE or Egypt?
If you have filed the divorce in Egypt, then you have to execute the judgment in the UAE and then place the claim here in UAE courts.
Or if it is not filed in Egypt, you can file in the UAE and then claim the money, as per Sharia law. Everything depends on where your husband lives.
