رفع قضية عمالية بسبب تأخر الراتب والمستحقات الأخرى ذات الصلة

طاب مساؤك سيدتي،
أعمل في منصب إداري بعقد غير محدد المدة بشركة ذات مسؤولية محدودة في دبي منذ الخمس سنوات الماضية.
عادة ما يتم تأخير رواتبنا، ولكن نأخذها في النهاية. ولكن منذ الخمسة أشهر الماضية ( من ديسمبر 2017 وما بعده إلى الآن ) لم يتم دفع الرواتب، حيث أن الشركة في فوضى مالية بسبب سوء الإدارة.
تم اقتطاع 25 % من راتبي في الفترة من عام 2014 – 2016 بإجمالي 36 شهرًا، وذلك بسبب عدم وجود أرباح.
فبالتالي أريد مساعدتك في المطالبة بالموضوعين السابق بيانهما. هل من الممكن أن تساعديني في كيف يمكن أن أطالب بهما؟
وأيضًا، هل يمكنني الحصول على تأشيرة عمل جديدة بينما تنظر القضية العمالية في المحكمة ( ليس تأشيرة العمل المؤقتة، حيث أن راتبي تم تأخيره أكثر من ثلاثة أشهر )؟
ما هي المدة التي قد تستغرقها القضية العمالية وما هي خطواتها؟ هل يجب علي أن أوظف محاميًا للقيام بذلك؟
هل يمكنني المطالبة بتعويضات عن الأضرار الناجمة عن تأخير دفع الرواتب من المحمكة العمالية أو المدنية، حيث أنني أدفع فائدة على قروض بطاقات الائتمان التي استخدمتها بسبب هذا التأخير؟

To answer your questions:

Can I get a new employment visa (Not the temporary work visa since the salary was delayed more than 3 months) while the labour case is ongoing?

- Temporary work permit.

What would be the labour case period involved and what are the steps in the same?

- File a labour complaint, and if the matter is not settled, then the court.

Do I have to hire lawyers for it?

- For the court, it is better, but not necessary.

Can I claim compensation due to salary delays from civil/ labour courts as I am paying interest on credit cards and loans which I used due to these delays?

- No, only your salary and dues.

Thank you very much for your response, Ma'am.

I have complained to MOHRE and the case is in the labour court now.

Just one clarification, more than 25% of my salary was deducted from 2014-2016 (36 months) citing low profitability and company situation which was promised back once the situation improves, but they are not paying it back.

Can I claim the same in the labour court?
