Inheritance procedures after the death of husband in the UAE

Procedures after the death of husband in the UAE.

I am an 88-year-old Hindu widow living in Dubai. My husband died in Dubai a few months ago. My husband did not have a Will.

I request assistance on the correct steps and procedures to get the money my husband had in his name and in joint names in Dubai banks and also some funds in India + plus one old car in Dubai.

There is also an existing execution case in Dubai courts where a person owes money to my husband.

I have a son and daughter and they are willing to make any POA or document that I might need.

A) I heard that first I have to start a "Succession Certificate file" and then I have to start an "Inheritance case". Is this the correct procedure? Do I need both steps or only the first?

Should I submit a list of known assets when asking for a Succession Certificate or when starting an inheritance case?

B) What documents do I need? What attestations should these documents have?

I am a poor lady, bedridden due to disease. I look forward to your help.

Dear Questioner,

Actions should be taken as follows:

1- Succession declaration applications for non-Muslims should be filed.

2- Inherintance file should be opened in order to receive all assets and distribute the amounts.

3- The form of the case running in Dubai Court should be corrected and the passed away husband should be replaced with the successor(s) or an attorney representing them.

Regards.

Thank you very much, Sayed.

Could you please guide me on what documents I should have with me before starting "Succession Application" and before starting "Inheritance File"?

What stamps should these documents have?

What happens if I do not know all the assets of my husband in advance and something is discovered later on?

Can the existing Execution Case be changed after the Succession file or only after the Inheritance file?

You need to have the death certificate and attested up to the ministry of Foreign Affairs if not issued from the UAE, application can be submitted by one of the heirs only who should declare the name of all heirs.

As for the case, yes, it can be followed before the inheritance file.

When you open inheritance file you may seek information from different banks or real estate companies about the assets and if any amounts will be found later it can be deposited in the same file and distributed in the percentage mentioned in the judgment of the declaration.
