Q: My fiancé is a French national & I am a Filipino national. We are looking into getting married here in the UAE.
We don't want to get married under the UAE courts and under Sharia law, if that is even an option for us, a church wedding is also out of the question.
Can you please advise what other options we have to be able to get married in the UAE, and the steps of doing so?

Q: Hello,
I would like to ask. In November, I will marry (Sharia marriage) a civic party of the Arab Emirates (a citizen of Dubai) and I will be his second wife. But I'm a citizen of Ukraine.
My fiancé gives me the same requirements and living conditions as the natives of Dubai. The fact that my child will have the same rights and will be like a child from the first marriage where the woman is a native of Dubai.
But I read an article that, like his wife and a stranger, I have no legal personality (inheritance, rights of UAE citizens, money for childbirth from the state...etc.) of the UAE citizens...etc.
I wanted to ask if it was true and where I can find this information somewhere. I used it on the UAE website but I didn't find anything.

Q: Dear Sir/Madam,
Conditions in Sharia marriage contract
My future husband (a Muslim expatriate) and I are going to register our marriage in the Sharia court in Abu Dhabi.
We have agreed that all property and money acquired after the date of marriage will be considered matrimonial and belong to both of us.
I would like to include this in our marriage contract. Would the following condition be valid:
"The property and assets gained by one of the spouses starting from the date of marriage are considered to be a matrimony property/asset and belong to both spouses equally."?
Please let me know what are some examples of valid conditions that can be included in a Sharia marriage certificate.

Can I hold the delivery of goods to a buyer outside the UAE if he defaulted on payment? 0
I, as a UAE-based Seller, entered a sales agreement with a KSA-based Buyer. The Buyer defaulted on the LC payment, breaching the contract.
The goods are stuck at the port as they need original documents, which I am holding to recover the outstanding balance.
They later made a partial payment but now threaten to cash the PBG (UAE bank) I provided if don't release the document.
The contract mandates DIAC arbitration but lacks a governing law clause. I need advice on:
1. Which law applies to this dispute?
2. Where can I seek an injunction to prevent PBG encashment, given the Buyer’s bad faith and breach? Or should I send a letter to their bank with the brief above?
Kindly advise.

I purchased a rented apartment in Abu Dhabi. Can I evict the tenant immediately if there is no Tawtheeq contact? 0
I recently purchased a rented apartment in Abu Dhabi and agreed to honor the existing lease. After the transfer, I discovered that the lease is not a Tawtheeq contract, meaning it is not officially registered.
Since I am not receiving rent (as it was a non-refundable arrangement with the seller), I prefer not to issue a new Tawtheeq. I also want to avoid a formal notice to vacate to prevent disputes, as I plan to move in.
However, I have already informed the tenant that I will not be renewing the lease. I need legal advice on the implications of proceeding without a Tawtheeq contract.
What are my risks, especially if the tenant refuses to move out?
What legal actions, if any, can the tenant take in this situation?

Hello,
I recently found an apartment for rent and agreed with the agent to make payments in three installments.
I provided the agent with post-dated checks for the second and third payments and planned to transfer the first payment, deposit, and agency fee to the agent’s account once the lease agreement was finalized.
However, the lease agreement has not been finalized yet, and I have since found a better place. Since I have not signed any lease agreement, should I be concerned about the landlord cashing the checks for the second and third payments? Is it legal?
Additionally, the agent requested an extra 2,000 dirhams beyond the amount he intended to include in the lease agreement.

My landlord issued an eviction notice stating an intention to sell.
He has since sold the property before the eviction date, and now the new owner intends to use the old notice to evict me and re-rent the apartment at a higher rate.
Is this allowed?

Canceling my MoU and getting my deposit back due to a low bank valuation and overpriced property 0
Hi,
I wanted to purchase a 2-bedroom apartment in JVC Dubai. I gave a 10% security deposit cheque to the seller. The price mentioned in the MoU is very high compared to other similar apartments in the same building.
The bank’s valuation also came in very low. Since the valuation is much lower, how can I terminate the MoU and get my cheque back? The MoU ends on 1st October 2024.
One of the articles in the MoU states:
In the event that the Buyer fails to make the payments as agreed or fails to complete the transfer on the agreed date due to his own acts or omissions, the Seller has the right to terminate this agreement and retain the deposit, provided that the termination is due to a violation of the agreed terms, unless both parties agree amicably to different dates.
I need help urgently.

Can I cancel my house sale contract without extra fees after personal plans changed? 0
Dear Lawyers,
I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August.
Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F.
The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer's real estate commission and the conveyancing fee.
Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this?
Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?

Can the landlord evict me from apartment for personal use if he lives in his own property? 0
The owner sent me a notice by email saying that he doesn't want to renew the contract for the purpose of personal use.
He didn't mention what this personal use means. He already has multiple houses for rent and he has his own which he is living in currently.
Is it legal to evict me?
