The procedure of ending a limited employment contract and notice period
Q: Good day I would like to know what's the law when I am cancelling my limited contract which is already 1 and a half year completed. Is there any notice period?

Difference between non-renewal and termination of labour contract
Q: I'm on a limited contract with a company in Dubai, I have been working since Jan 2011. My current labour contract will expire on 21 Jan 19 & my residence visa will expire on 3 Feb 19. I have informed my company not to renew my contract on 30 Dec 18 & want to discontinue working. Now, they say that I need to provide 3 months' notice for non-renewal of contract and wanted me to work until 31 Mar 19. Can you please advise

Obligation to pay visa expenses to employer in case of early resignation
Q: Hello, I am from Bosnia and I currently work in Dubai. I came here on the 13th of November this year. Currently, I have only an entry visa and I'm waiting for the medical exam to get visa stamped in my passport. My employer didn't give me any contract to sign. He provided me with a visa, accommodation, transport and food. Now, I have an emergency situation back in Bosnia and I have to go back. The employer told me that I have to pay for all the expenses to him if I want to go. Do I have to pay it due to not having and signing any contract? And when I have my passport back, will I be able to go home without paying expenses to him? I asked him for the contract, he said that I don't have to sign anything.

Q: Hi Ma'am, Is there any law written that the employer has to pay the cancellation fees? It shows me it will help us in the future. The company management is asking for it. Is there any law?

Asking an employee to pay money to get the cancellation letter
Q: Hello, My cleaner's (laborer) visa is expiring in Nov 2021. I want to renew my visa with a new company. The old company which had given the visa is charging me 1000 AED for the cancellation letter. Is this legal? If not, how can I complain and get a cancellation letter at a proper price? Thank you for any guidance!

What do "the costs of recruitment or contracting" mean in the Federal Decree-Law No.33?
Q: Dear sir/madam, I want more explanation of clause 3 of article (9) of the Federal Decree-Law No.33 which states the following: If the worker wishes to move during the probationary period, to work for another employer in the State, he shall notify the original employer of the same in writing within not less than one month from the date of his wish to terminate the contract. then, the new employer shall compensate the original employer for the costs of recruitment or contracting with the worker, unless otherwise agreed upon. What do "the costs of recruitment or contracting" mean?

Cleaner's resignation with 30-day notice in incomplete contract
Q: Hello, Good afternoon! My friend works as a cleaner for a cleaning company and she now wants to resign with a 30-day notice. However, she has not completed the two-year contract and has only served for 16 months. Additionally, she has not taken any vacation leave. The sad part is that when she signed the offer letter, she did not receive a copy of it and only signed it. I would be very grateful if you could let me know if she would have to pay or if her boss has the right to not accept the resignation if the notice period mentioned in the offer letter is more than a month. Her boss has not provided her with any kind of proof that she can use in the future if anything happens.

Q: Dear Sir/Madam, I have completed 20 months of my work contract, and now I want to resign from my job. If I resign, what settlements will I receive from the employer? Will the employer charge any costs if I resign before completing 24 months?

Am I responsible for insurance and visa fees upon early contract resignation?
Q: Dear Sir/Madam, My contract is for 2 years, limited. I resigned after 1 year and 5 months. The company asked me to cover medical insurance, labor insurance, visa status change, and Emirates ID charges. Am I liable to pay this amount to the company? Please let me know the calculation of the leave salary. Is the calculation based only on basic salary and HRA allowance or the full salary including all allowances?

Can I cancel my house sale contract without extra fees after personal plans changed?
Dear Lawyers, I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August. Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F. The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer's real estate commission and the conveyancing fee. Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this? Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?

Can the landlord evict me from apartment for personal use if he lives in his own property?
The owner sent me a notice by email saying that he doesn't want to renew the contract for the purpose of personal use. He didn't mention what this personal use means. He already has multiple houses for rent and he has his own which he is living in currently. Is it legal to evict me? Thanks
