The rights of an employee who works for another employer upon terminating him
Hello sir,
We have an employee who was under probation period on a limited contract and with our company visa. The performance is poor and it is found that he is working for another company (his old work) while working with us.
So the management decided to terminate the contract. Apart from the salary, do we have to pay his ticket fare?

Dear questioner,
According to the UAE Labor Law, the maximum time limit for the probation period is 6 months as shown below in the UAE Labor Law Article 37 of 1980:
"The employee may be appointed for a probationary period not to exceed six months, and the employer may terminate the services of the employee during this period without giving notice or end of service remuneration. Appointment of the employee on probation basis in the service of one particular employer may not be made more than once. However, if the employee passed the probationary period satisfactorily, and remained in service, such period of service shall be computed in the period of his service."
It means that he is not entitled to claim any of the employee's rights during the probation period of the private sector of whatever kind due to not completing the period stipulated in the UAE Labor Law such as his ticket fare.
