Q: I want to early terminate my tenancy contract of one of my nurseries in JLT (retail unit) as the business is completely shut since March. I am unable to contact my landlord who is a Chinese national; he does not reply to email or call and may not be in Dubai.
The final cheque is due 01 May 2020, what should I do?

Penalty for early termination of the lease contract

Q: I have a studio in discovery gardens. I have taken it on 4 cheques. My 3rd cheque is from this month, mid of April until mid of July.
I have been transferred to Amsterdam and need to report on duty from June. I have informed the real estate for early termination.
They told me that beside this cheque, I need to pay 2 months rent plus 1000 penalty.
Can you advise how much do I have to pay for early termination as per the law?

Harassment by a landlord

Q: I have a friend who is harassed by her landlord. She vacated the flat even though she has 3 more months in the contract. This landlord is harassing her and doesn't want to give the clearance to her and asking additional payment which is out of the contract. This landlord is threatening her to file a complaint to the police.
What can she do to this matter?

The landlord is unreachable. What to do after the lease contract expiry?

Q: Hi all,
My lease contract for the apartment has expired. The landlord has not contacted me for 4 months and I was of the impression that due to Covid, he may be stuck somewhere and I was waiting for him.
Now, 4 months have passed from the expiry of the contract and the landlord has not contacted me still. What should I do and as per law, whose mistake is that?
What should I do?

انتهى عقد الإيجار منذ أكثر من سنتين، وتم التمديد ودفع كافة المستحقات حتى تاريخه.
استلمت إنذار من محكمة رأس الخيمة بالإخلاء لعدم تجديد عقد الإيجار ومبلغ ٣ أشهر فقط مستحق، على الرغم من أن عدم تجديد العقد كان تقاعسًا من شركة العقار، لذلك تم التمديد ٣ أشهر بعد ٣ أشهر إلى آخره حتى تاريخه.

Should I visit the Evacuation Department in person to complete the eviction and get my keys?

Q: Dear Lawyers,
I opened an execution case against my tenant who was not vacating the apartment and was not paying the rent. After the execution date, I received a report from the police that the apartment is being evacuated.
However, when I created a "Request to follow up execution proceeding" e-request to complete the process and get the keys, my request was rejected with the message "على مقدم الطلب مراجعة قسم الاخلاء," which translates to "The applicant must refer to the Evacuation Department."
So, do I need to personally visit the Evacuation Department? I am outside the UAE but can come to the UAE to get the keys.
Or, do I need to create an e-request in a different category?

I was evicted after a rental dispute case and handed the keys over. How to make the landlord update the system?

Q: I had a rental dispute case with my previous landlord. I’ve been evicted now, and she took the keys right there in the presence of the police she came with.
Upon going to Takhlees in Deira to open an account for installment payment, she hasn’t put on the website that the keys are handed over.
I’m waiting for this because money keeps piling up since I last vacated the premises. I have been placed on a travel ban, which is also affecting my visa status. I need to regulate.
Any advice, please? What to do?

Canceling my MoU and getting my deposit back due to a low bank valuation and overpriced property 0
Hi,
I wanted to purchase a 2-bedroom apartment in JVC Dubai. I gave a 10% security deposit cheque to the seller. The price mentioned in the MoU is very high compared to other similar apartments in the same building.
The bank’s valuation also came in very low. Since the valuation is much lower, how can I terminate the MoU and get my cheque back? The MoU ends on 1st October 2024.
One of the articles in the MoU states:
In the event that the Buyer fails to make the payments as agreed or fails to complete the transfer on the agreed date due to his own acts or omissions, the Seller has the right to terminate this agreement and retain the deposit, provided that the termination is due to a violation of the agreed terms, unless both parties agree amicably to different dates.
I need help urgently.
