I have 4 cash cheques dated 28.10.2020, 28.11.2020, 28.12.2020, and 28.01.2021 which all are cash cheques but unfortunately, still one single cheque didn't pass because of insufficient funds in an account. I have been asking my boss politely for paying for the past 8 months. In the beginning, he behaved normally and asked me some more time but now he is telling me that because of me, some projects got problems and he didn't get payments. Now I am in India and I have some medical issues for which treatment is going on. Presently I can't come to the UAE to fight with him. Is there any way to get my money back? Please help me to get my money back. Thank you!

Q: I am into diesel trading business. One of my customers owes me AED 144,500. He issued me two cheques of 100,000 of each. He told us he had 10 heavy vehicles. We supplied diesel to him for two months. He defaulted on payments and stopped answering calls. After this default, I inquired with one of his drivers and he told me none of the 10 vehicles is owned by him. He along with his colleagues, present themselves as a transport company and defraud the diesel supplier by issuing post-dated cheques to them and selling the diesel purchased in the open market at half the price. I have already filed a cheque bounce case against him. Apart from the cheque case, can I file a cheating case against him? If possible, what are the documents required to file such a cheating case?

Q: Dear Mrs Khan, I have recently received a Post Dated Bank Cheque from one of my new clients, the cheque date is Thursday 19th Apr 2018. Today, I called this client to find out that they are not answering calls, and when I went to their office I found it closed and many of their suppliers in the corridors complaining about their Bank Cheques that were bounced back (rejected). The owner of this company seems to have already left the UAE and none of his employees is answering the phone. So most probably the bank cheque that they gave me (AED 57250) will bounce back Thursday. So I want to start taking action now. I sold them 10000 boxes of 15 Kg lemon, which they stored in a third-party cold storeroom in Dubai. I went and found that the lemon is still there. Q: Dear Lawyers, My case is in the execution court. I have taken multiple measures, including blocking the company’s traffic file, bank accounts, and trade license, but the company has neither paid the dues nor responded. Finally, I requested the court to impose a travel ban on the company’s manager, which the court approved. However, the defendant has repeatedly requested the court to lift the travel ban, arguing that he is a local national and the case is against the company (an LLC), not him personally. So far, the court has rejected his requests. Could you please advise on further actions I can take to recover the funds? Can I request an arrest order? If yes, on what grounds? Also, is there any possibility that the court might lift the travel ban without the payment being made?

It is covered under the purview of Commercial Transactions Law, and legal implications/penalties can be financially severe and daunting for more “serious” offenses. The provisions of this law, promulgating UAE Civil Code, govern the civil transactions in the United Arab Emirates. The commercial transactions remain subject to the laws and regulations applicable in their regard.

The provisions of this Law apply to the commercial companies established in the UAE and the foreign companies that have established in the UAE a base to conduct any activity therein or established a branch or representative office. The Law abrogates Federal Law No. (8) of 1984 Concerning Commercial Companies.
