Q: Hello.
I hope I can get some good insight from you. I have tried to reason with my landlord to allow me to break my tenancy contract early. He refused.
Now what legal action can I take, and can I refuse to pay the full amount as too many shortfalls in the building? It is very dirty, never cleaning, the gym is so dirty one may get a disease, faulty equipment, very bad maintenance, a pool no one can access... so many.
What can I do about it? Can I refuse to pay the whole amount? Who can I complain to? I need some info to know what to do.

Terminating a tenancy contract by a tenant because of smoking neighbors

Q: Hi,
I have spent just 1 month here in my new apartment with my wife and my 6 months old baby. Our neighbor is smoking inside their flat and the smoke comes inside our flat. We have already complained about it to the management and the management keeps only warning them.
I have a baby who is at risk for smelling cigarette smoke and we've found out that the tenant has many complaints already. The management seems very soft to them. Are we allowed to break our tenancy since the management fails to control them?
I think they have a friend who is a senior manager of the building and that's why they keep on doing crazy things without eviction.
Can we terminate our contract for this reason since we have a baby?

Consequences of terminating a lease contract after releasing first payment

Q: Hi,
I signed a lease contract for a villa in Dubai with start date Nov 1st. Paid 5% deposit to the landlord and a 5% fee to the real estate agent.
Now, as we start discussing details about the move, we are not happy with how the landlord is discussing some small terms.
They are not major issues that would allow us to legally terminate the contract but small things that do not give us the confidence that our life would be easy with them in the future.
Therefore, we would like to cancel such lease contract with start date Nov 1st.
Question is what would be the consequences of such termination? Considering that the contract has not yet started, could we just cancel it now without any penalty and getting our deposit back?

Q: I have rented a flat in Dubai through a private real estate company since 2016. I have Ejari Tenancy Contract Registration Certificate which mentions that the flat size is around 800 square feet, but in fact, it is around 400 square feet.
Can I have the right to take any action against the real estate company?

Q: Dear Mr Malalla,
I would like to get your opinion on an incident that I am going through at the moment with my previous landlord.
After staying in the same apartment for 4 yrs as a tenant, on 8/2/21, only a week before the renewal term (15/2/21) and after having a written agreement on a mutually agreed condition as well as sending us the contract, our landlord declared to us that he changed his mind and would apply the old contractual terms.
After having back and forth emails with our landlord's agency, on 23/2/21 we received the final email about his decision from the agency. As I did not want to stay in his place, we moved out on 6/3/21.
On 14/3/21, we received a quotation from the agency in regards to maintenance, which we mutually accepted on 15/03/21.
2 days ago, when I was waiting for my security deposit, I received a final calculation from the agency charging me the period between 15/2 to 5/3 as overstay. We reminded him many times of the rules and regulations but he does not care.

Annual gas consumption included forcefully by the real estate agent in contract

Q: My Real Estate agent has included annual gas consumption charges in the contract and forced us to pay, even though we don't have a connection.
I don't use gas and don't need one (Using an Electric cooker and having food delivery service from outside).
Let us know whether it is legal? And what options do we have?

Can my community deny access to parking and facilities if I signed a tenancy contract but no Ejari?

Q: Good afternoon,
Hope you are all in good health!
I'm renting a property in a community, and this is my second year. I have a tenancy contract signed by both the landlord and me; however, Ejari will take some time to be processed.
I understand that, as per the community rules, access cards for community facilities (such as the pool, gym, etc.), along with the parking access card, will be deactivated until I get Ejari. However, is this legal?
Since I have paid the rent and have a signed tenancy contract, can they do this?
My questions:
1. Does the community have the right to deny me access to parking and facilities if I have a valid tenancy contract but no Ejari?
2. If they have the right, then that's okay. But if they don't, what should I do if they stop me from using my parking space?
3. Should I call the police if security denies me access to parking?

Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
