Q: I received an employment contract from an oil company in the UAE and they said to contact a travel agency. Please, how to check whether it's fraud or not sir?

Q: Respected Sir / Madam, On Mar 2014, my manager was in the process of transferring my visa to the main company. On his personal guarantee and assurance, he asked me to sign the receipt of AED 34,894/- towards my full and final settlement for the period I worked from August 2007 to March 2014. Nevertheless, he never made any payment and just assured that he'll pay the same later, saying that the company used my dues for company urgent expenses. Also between April 2014 to December 2014, and on many occasions, he requested on his personal guarantee and assurance to use my credit card for company official payments. The amount outstanding is AED 13,337/-. When I started to follow up on my dues, he simply kept dragging and assuring the payment. I begged him many times to clear my dues but he never made any attempt to pay my dues. He conned, lied and cheated me with my hard earned money, along with the employer. The company is closed now and we both are working in different companies. Please advise regarding the legal options to get my dues from him. Regards, Vinod

I received an offer from an LLC without an interview, and the offer letter also does not contain the landline number 9714...; instead, it is 9715... The first offer mail was sent from a Gmail account. I questioned this with the company by sending them a mail to the address on their website being [-----.com] and asked if the offer was legitimate. I then received a response from this e-mail that they are awaiting my signed offer. How will I know now if the offer is legitimate?

Q: I have had a domestic worker ‘nanny‘ under my sponsorship for 7 years. She decided suddenly to terminate our existing contract which will end after 4 months and ran away with her boyfriend! Tried to negotiate with her to come back till I search for a replacement but unfortunately, she did not agree. I usually take her with me to renew her working visa and contract in TADBEER. But last year, after reaching there, my son was sleeping in my car and she stayed with him. I had to sign the work contract on my behalf and her behalf in front of the officer who told me it is ok as she was our nanny for 6 years that time. I’m not sure if I finger stamped on her behalf or not. My question is: can she file a case that I signed on her behalf on the maid contract? If she did this, what will the consequences be on me? Q: Dear Concern, This is an absurd issue I need help with. Someone has issued a work permit or a labor card using my details (passport information) without my consent. When I attempted to apply for my first-ever employment visa, the system indicated that I already have a work permit or labor card with another company. Tasheel provided me with the labor information and a company name that I am unfamiliar with. How should I proceed and get assistance from the authority in this matter? Please note that I have never applied for employment in the UAE before.

The fraudsters allegedly post jobs online or even on reputable websites like #Monster.com or #Naukrigulf.com with too good to be true salaries and unbelievable benefits. Then WITHOUT an interview or fake telephone call interview (which is never done for real jobs in the UAE) provides an offer letter which includes the names and logos of the employer with or without the UAE Embassy stamp and then asks you to pay processing or visa fee to a travel company or exchange companies. BEWARE!

Further to my article Scam Alert: Fake UAE Job Offers, I believe the scam artists have read the same. Yes, I call them the artists as it is an art to fool people. They have paid attention to every aspect of my article and now have come up with an innovative way to scam the job seekers. Therefore, my revised strategy in this article.

The UAE has adopted a major reform in its legislative system that brought about 40 new laws and amendments to the company law, criminal law, personal status, among others. The amendments aim to develop the legislative structure in various sectors, the labor law being one of these, was the most recent. We try in this article to shed light on the changes introduced with the new labor law and their significance on both, the employer and employee.

The UAE Penal Code, like all other laws, addresses the crime of fraud in Article 399 of the UAE Federal Penal Code, which stipulates that whoever seizes, for himself or another, a movable property, or obtains a document or signature thereon, cancellation or destruction thereof or amendment thereto by fraudulent means, or by assuming a false name or capacity, where such an act leads to deception of a victim and leads him to surrender shall be punished by imprisonment or fine.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

According to this Decree, tentative approval to admit a foreign worker for the purpose of employment in the UAE cannot be granted until an Employment Offer that conforms with the Standard Employment Contract is duly signed by the employee and presented to the Ministry of Labour.
