Negotiating with the bank for defaulting on credit card payments
0
Q: Hie Rajasree,
I have had a few credit cards from 2015 to 2016 in Dubai (UAE) and after that, I lost my job.
I survived on cards so that I could find a new job and repay back, but was unable to do so. Currently, I have a total debt of AED 80 to 90k in 5 different cards.
I just want to know, if I want to settle the dues, how much amount can I ask for the waiver from the finance companies?
And as per your experience how much % the bank give a waiver?

Loan settlement with a bank after losing job

7
Q: I've taken a loan for 5 years from a bank in Dubai. I've paid for 2.5 years, then I've lost my job and had to leave the country.
Until now I can't find a job. I couldn't pay the loan instalment for 8 months.
The bank said that they've already written off the loan and is threatening to file a police case. The remaining loan is AED 340k. All I have now is only 150k.
I'm afraid that I pay what I have, then stop paying. And then the bank will file a police report. What should I do?
Is it possible to reach a deal with the bank to pay the 150k and they close the case and give me back the cheques?
If they're going to file a police case anyway, then it's better that I don't pay the 150k. It'll be a lose-lose situation for me and the bank.
I want to hire a lawyer to help me close this issue. And explain to me what are my options and how much will his service cost me.

What to do to convince the bank of a settlement offer
1
Q: Hi,
I've been out of work since September 2019 due to company restructuring, though I work there for more than 13 years.
As of now, I still have a debt of 170k (150k as principal) with Bank M and 19k (8k principal) credit card debt with Bank F.
I already contacted Bank M that I'm willing to settle the loan but if they could bring down the amount to 70k as I only have 40k on hand while I haven't talked to Bank F yet.
Is there any way that we could bring down the amount?
I still don't have any work until now and I'm just on wife support.
Thank you and Best Regards.

How to settle an outstanding loan before returning to the UAE and finding job

1
Q: Hello,
I left the UAE with an outstanding personal loan (almost 200k).
I believe the security cheque has been deposited due to non-payment from my side and a criminal case filed against me, which I am not sure about.
I have informed the bank that I will be settling the loan amicably once I land a job. At this point, I don't plan on coming back to the UAE.
But I would like to resolve this issue and maybe get legal advice for removing the case and finding a reasonable settlement amount.

The judge denies all installment requests. What should I do?

3
Q: Hello,
I lost a case and must pay 42,000 AED. I don't have the money and am unemployed. I tried my best and was able to pay 11,000 AED.
The judge is denying all my installment requests. I tried for 9 months, then 8 months, and now 7 months. He denied all of them.
I'm really frustrated and don't know what to do. I don't have another way to pay. What should I do?
Thank you in advance!

Can I return to the UAE and find work after leaving with an outstanding loan?

1
Q: Hi sir,
I have an outstanding loan in the UAE. I was terminated by the company and sent back home. Before that, I was paying my EMI promptly, and I would like to repay the outstanding amount even now if they restructure my loan.
How can I determine if I can work again in the UAE without any problems?
Will I be detained at the airport upon arrival?

The management of individual financial affairs is crucial and all the actions must be weighed down while committing to any financial liability. Whether it's job loss that may have lead to financial failure or the opposite, one must be aware of the personal liability which will not diminish by paying fines for cheque bounce cases. There are two major types of liabilities, criminal liability and civil liability. Each has its own significance, hence, must be dealt with accordingly.

View allSalary delay as a reason for filing a labor case and joining a new employer 0
Hi,
I am employed in Abu Dhabi. My employer owes me 2.5 months of salary as he didn't pay me on time. I have a job offer from another employer wherein I have to join immediately.
They will apply for my new visa. If I request to cancel my current visa and get a new visa from the new employer, can I still sue my previous employer after 1 or 2 months?
Could you please tell me my options in this?
I have to obtain a new visa from the employer and some international travel requirements are there in my employment.

Request to extend rent for a few days and landlord's right to charge me for that 0
Hello,
I had provided 90 days' notice of tenancy cancellation to my landlord and he acknowledged the same.
As per this, I am supposed to vacate the villa on 20 July. I now need to extend my stay for 4 additional days (21 - 24th July), due to unforeseen circumstances.
What is the rule in this regard? Can a tenant request for the same and is the landlord obliged to agree?
Or can he charge me for the 4 extra days on a pro-rata basis?
For your info, I have been a tenant at this villa for 8 years.
Thank you for your assistance.

Is the tenant obliged to extend tenancy for one month to meet the notice requirement? 0
In my tenancy contract I have this clause:
"If the tenant intends to vacate or renew the tenancy on the expiry date, he/she agrees to give the landlord at least ninety (90) days written notice.
a) Renewal should be signed and the rental cheque has to be paid 1 month before expiry, otherwise, the landlord has the right to find a new tenant."
I gave the landlord notice 60 days prior to the expiry date. Now he is asking for a penalty of one month from me or extending the contract for 1 month with an additional one-month payment.
However, in the clause, I don't see any reference to such a penalty. The only written sub-clause is that renewal should be signed one month before expiry, otherwise, he can find another tenant.
I want to leave the last day of the contract, therefore I don't have any issue with him finding another tenant afterwards.
Based on the above, is he eligible to get a penalty?
Kind Regards,
D. D.

Can the landlord disconnect property utilities in case of defaulting on rent? 0
My contract is expiring at the end of this month. The Lessor of the property management has notified me to pay the pending amount of my rental dues by the 15th of July. Failing in which they will disconnect my utilities.
I have delayed my payments but I have somehow covered my monthly rentals. I am still due to pay some amount to them. Previously when this situation occurred, they have disconnected my utilities.
Can anyone suggest to me whether this is legal to disconnect utilities?

I have a police case in Ajman court. The judgment is AED 1100 fine and 1-month jail.
I paid the fine but I did not go to court and surrender to 1-month jail.
Now my visit visa is expired and I cannot extend it. I want to go to my country.

Transferring the employees to a new company without paying the gratuity 0
Hi,
My company in DMCC is planning to shut down. They are not willing to pay us the gratuity.
They have offered the remaining staff, including me, to be transferred to a new company they are opening soon.
Is there any way we can get a continuation of the contract in order not to lose our gratuity in the long run?
We have all been in the company for more than 8 years now.
Many thanks,

A rented premises is sealed by the court. How can the landlord get it back? 0
We have an enforcement order against our company due to a commercial case in Dubai courts filed by one of our creditors and the office is sealed by the court.
The Ejari for the office has expired, in the meanwhile, the real estate is asking me to hand over the office or face another rental case as we are still liable for the rent.
The civil case matter is involving a large sum of money which the company is not in a position to pay right now but does not want to be liable for another court case.
Is there a way for the landlord to get their premises back?
How long would the court keep the premises sealed until their next step?
