المطالبة بالتعويض واسترداد الأموال بالكامل بسبب التأخير في تسليم العقار

أحتاج إلى المشورة.
لقد اشتريت عقارًا لا يزال قيد الإنشاء.
شروط الدفع كانت 40٪ أثناء البناء و60٪ عند التسليم. لقد دفعت 70٪ من قيمة العقار (لن يتم ذكر اسم المطور العقاري هنا).
وفقًا لاتفاقية البيع والشراء، كان من المفترض أن يكون التسليم في شهر ديسمبر 2018 وتم تأجيله لأكثر من 15 شهرًا. من المتوقع حيازة العقار بحلول نهاية العام.
أريد أن أعرف عن إمكانية الحصول على تعويض بسبب التأخير (يغطي بشكل أساسي خسارة الإيجار المحتملة أو تكلفة الفائدة) أو إنهاء اتفاقية البيع والشراء واسترداد كل ما دفعته.
هل يمكن أن يخبرنا أي شخص ما هو متوسط أتعاب المحامي ومصاريف المحكمة؟
مصاريف التقاضي: هل سيدفعها المطور العقاري في حال كان حكم المحكمة في صالحي؟

Regarding that, we would like to inform you that based on your aforementioned story you have an absolute legal right to claim your money back, terminate the SPA, and claim reasonable compensation from the developer due to delay in handover of the project at the expected date.
However, the real estate law in the UAE has been given permission to the developer to delay for a maximum of 12 months (THAT SHOULD BE MENTIONED IN THE SPA), otherwise, the developer has no legal right to delay handing over of the property.
Apparently, we have to review the SPA and any other related documents after you provide them to us via email so then we can provide you with relevant legal advice, court fees, our professional legal fees (lawyer fees), and the expected time for pleading this case as well.

If the developer did not complete the project upon the date of completion, you have two options:
1. Option 1: You can file a case against the developer for termination of the Sale and Purchase agreement and claim a full refund of the money paid from the developer along with an interest of 12%.
2. Option 2: You have the option of continuing as a buyer in the project and file a case seeking compensation from the developer for the delay in the handover of the property.

In this type of real estate cases, many points need to be checked before giving legal advice, including but not limited to, the agreement itself, anticipated completion date, permitted extension, RERA project progress report and the communication with the developer towards the extension of time.
If the developer cannot complete during the anticipated completion date and its extention you can claim termination, refund, interest and if he can complete with minor delay court may consider that the developer acted in good faith and you can claim compensation providing that you can prove the damage.
IN ALL EVENTS, THE LOSING PARTY WILL BE OBLIGATED WITH COURT FEES. As for the professional fees, it depends on the claim amount and can be discussed.
