Compensation for property handover beyond the exact date

I purchased a property that was to be delivered on 15th June 2020 as per the SPA. It was also stipulated in the SPA that the developer can delay the handover by up to 12 months (15th June 2021).

The developer has informed me that they will hand over the property on 15th September 2021; meaning they are in violation of the SPA. I asked for compensation for the 3 months but they have refused.

How can I proceed with it now? Do I need to file a civil suit?

Yes, you need to file a lawsuit against the company in order to be able to obtain the appropriate compensation for you in this case.

I have handled many of these cases. You can contact me for further assistance.

Dear questioner,

As the developer has defaulted on his basic duties by delaying the handover of the property, therefore, you have full rights to terminate the mutually signed SPA and ask for a refund of all investments along with compensation.

Kindly contact us directly for a detailed discussion.

If need be, kindly contact us via phone for a detailed discussion or write us an email for further assistance.

Hello,

To start with, since the SPA is clear about the handover, you can either terminate the SPA and ask for a refund plus the compensation, OR, ask for compensation for the 3 months delay.

If you need any legal assistance, contact us on WhatsApp or call us or write an email.
