Can I request changing a limited contract to unlimited to resign without restrictions?

Good Day, Ma'am,

I am S. H. from India and working with the waste management company in Abu Dhabi. My employment contract is limited and finishing in June 2021.

I want to change it to an unlimited contract so I can leave whenever I want for a better opportunity.

Requesting your valuable advice, thank you.

Regards,

S.

Hi S.,

Please request your employer to issue an unlimited employment contract at the time of renewal.

However as per Ministerial Decree (766) of 2015 on Rules and Conditions for granting a permit to a worker for employment by a new employer, even if it is a limited contract, you may unilaterally terminate the contract provided:

1. The terminating party notifies the other party in writing of his/her intent to terminate the contract in accordance with the notice period that was agreed to by the two parties, not to be less than one month and not to exceed three months.

2. The terminating party continues to honour the contractual obligations for the duration of the notice period.

3. The terminating party indemnifies the other party in the amount that was agreed to by the two parties, not to exceed the equivalent of three months of gross wages.
