Suing an employee for destroying company's mobile data before resignation

Hi friends,

Good day!

One of our employees has given resignation. Soon after he resigned, we asked him to return the company assets given to him, however, while returning the mobile, he deleted all information and chat history.

He also did factory settings on the mobile. Before the factory setting, he backed up all data on his personal phone.

Please advise what remedy the company has against the employee for destroying company data & stealing customer information from the company mobile.

Good day!

If the employee has deleted the messages in the mobile and assets belong to the company, we can file a criminal case against him.

We can file the case of cybercrime which gives 2 years imprisonment and deportation. Moreover, a case for breach of trust which also gives him 2 years imprisonment and deportation can be filed.

Therefore, we can file cases against him on two counts. So, I think when he is arrested by the police, he will come into and settle to your terms.
