هل يحق للأب المطالبة بحضانة ابنه الذي يريد ذلك؟

مرحبًا، 

أنا هندي الجنسية وأعيش في إمارة أبو ظبي منذ عام 2007. زوجتي التي تحمل تأشيرة عمل شركتها انتقلت إلى منزل منفصل في بداية عام 2021 مع طفلي البالغ من العمر ست سنوات (والذي يحمل أيضًا تأشيرة الكفالة الخاصة بها).

في الوقت الحالي، إنها لا تسمح لي بلقاء ابني بينما أعرب ابني بوضوح عن رغبته في البقاء معي بشكل دائم ولا يريد البقاء مع زوجتي.

ما هي حقوقي القانونية من حيث:

أ) حقوق الزيارة

ب) حضانة الطفل

You are the legal guardian of the kid, you should approach the court and file an application for the visit and meet your kid. You will be (most probably) permitted for visiting.

Good day!

You can file the case for custody of the child in Dubai or at least visitation rights in Abu Dhabi Court.

If you want to file a divorce, you can file or you can only ask for custody of the child. The child is yours and there's a possibility that the judge might award and you can have visitation rights.

I'm sorry to ask but we need to review the religions because if it is a Muslim, that will go as per Sharia. If it is Hindu, you can file as per the Hindu Marriage Act. And if it is Christian, it should be as per the Christian Marriage Act in India.

According to the new law, these foreign divorces are recognized as the foreign law can now be enforced in personal matters.
