استعادة المبلغ المدفوع من متعهد بسبب تأخر مشروع
قمت بحجز وحدة استوديو لم تُبن بعد بمشروع رويال استات بمجمع دبي للاستثمار. وقد أرسل لي المتعهد العقد لتوقيعه، فوقعته وأرسلته إلى عنوان الشركة.
أتعامل مع شركة تكستشر بروبرتي بدبي، وقمت بتحويل 10% من المبلغ لحجز الوحدة في يونيو 2015، ودفعت أكثر من 30% من ثمنها حتى ديسمبر 2016.
توقفت عن دفع الأقساط عندما رأيت تقرير البناء على موقع دائرة الأراضي والأملاك فوجدت أن الشركة لم تقم بوضع لبنة واحدة لبناءالوحدة، ولم يعطني المتعهد عقدًا رسميًا.
وحتى الآن لم يتم بناء أي شيء وفقًا للتقرير للمشروع الذي يحمل رقم 1514. أفكر في المطالبة باستعادة المبلغ.
السعر الإجمالي للاستوديو: 33000 درهم، تدفع كالتالي: 10%، 36 قسط متساو خلال التشييد، ثم 20% وقت التسليم، 18 قسط متساو بعد التسليم.
قمت بتسديد 10% ثم 18 قسط من أصل 36 قسط خلال مرحلة التشييد وفقًا للعقد. المبلغ الكلي: 109,973,94 درهم. المدفوع: 109,973,00 درهم.
ما هي احتمالية استرجاع المبلغ من المتعهد؟ وكم ستتكلف هذه العملية؟

Further to your query, kindly be informed that we shall be needing signed Sale and Purchase Agreement for our review.
Thereafter, we can advise you on whether to claim the refund or any other step involved.
Generally, if the delay is huge and the construction is below 70%, we can claim the refund.

You can refund your paid amount due to the developer's breach of the terms which is surely mentioned in the contract.
