Q: Hello,
I got a job offer letter in July 2018 for internal medicine specialist position at a hospital in the UAE.
After receiving the offer letter, I obtained the license in August 2018 and paid a fee amount of AED 3020. Then I got from the same hospital's job offer agreement and visa application form to fill.
I was supposed to start in November 2018. I was asked also to finish my notice period in the previous hospital. When everything was done, the hospital decided to put my position on hold.
Since then I am jobless and still waiting to start my employment according to the job offer agreement. Do I have any rights for compensation?

Q: Madam,
I am in India and have an offer from a top construction company in Abu Dhabi. The employment offer has been signed by both parties. I have passed on all the information required for VISA processing.
The last point in the offer says, Commencement of Employment - Upon reporting to duty. Now, this point puts me a question mark in my mind. What is the tentative date?
The employer can say, once the projects start we will apply for VISA...etc. This puts me in confusion on how long to wait as I have resigned from the current company.
Or is it the standard format in the offer as the employers are unaware of the time required for VISA processing?

Is employment offer (LOI) a legally binding document?

Q: I'm a German national who got an offer for a job in JAFZ, which I subsequently accepted by signing an "Employment LOI" starting 09.04.17.
On 10.05.17 the LOI was revoked because my work permit got rejected by the DNRD. The reason for rejection was not given and I was told by company's PRO that I'm not allowed in Dubai. I have never been in Dubai before the rejection.
I contacted JAFZA and found out that the PRO made mistakes in submitting the application. A company letter was requested and was never provided.
The PRO convinced the company that my father's religion "Shiite" and my birthplace "Lebanon" is the problem. I was then told by the PRO that I'm not allowed to enter Dubai. I was able to enter on 15.05.17 without any problems.
1. Is the LOI legally binding? It does not state any conditions concerning the visa.
2. Can I sue the company under the anti-discrimination law and demand compensation?
3. Can I find out why DNRD rejected the application as the company is refusing to ask for clarification?

By this Decree Ministry of Labour of the UAE has removed the six-month labour ban for those who changed the job before completing two years of service. Labour ban will be still applicable for workers that qualify for skill level 4 and 5 under various circumstances.

Calculation of gratuity when the current salary is not the same as the salary in the contract 0
My employer put my salary in the agreement as 800 AED since 2012 and still the same. But, my present salary is 2000 AED.
Q1: How they will pay my gratuity if I cancel my visa from the company? According to my agreement salary or my present salary?
Q2: If they hold my passport after canceling my visa, then what can I do?

Filing a complaint against a company after withdrawing a job offer 0
I signed an offer letter and a copy of a contract in a company located in Dubai Design District.
I resigned from my current company located in Jebel Ali and will be ending my noticed period on April 4, 2021.
Now the new company is really unclear about when I can start joining them. If the company does not pursue my hiring, but I have already resigned and lost my job, are there any legal complaints and claims I can file?

The consequences of changing the nationality of an ex-pat 0
I have a working visa in the UAE. I have decided to apply for an EU passport.
Once I receive it, I need to surrender my original passport to the consulate since my country does not allow dual nationality.
I will be informing my company HR about this. I would like to know:
1. Can the company terminate me since I have joined under a different nationality?
2. What will happen to my end-of-service benefits?
3. Do I have to undergo a medical test, get a new Emirates ID, update my bank accounts, phone registration, and other documentation?
4. Anything else to be done?

The rights and obligations of a freelancer regarding gratuity and non-competition 0
Good afternoon.
The company terminated my unlimited full-time employment contract after 3 years, so not renewing my visa. I am working on my own visa now and continue as a freelancer.
But they want me to sign their freelance/consultancy agreement with a clause that I am not allowed to work for any of their competitors (but they don't provide me with a visa, medical, no benefits, even not giving me enough working hours).
1) Is it legal to ask a freelancer for this exclusivity?
2) How I can be a freelancer and not allowed to work for other companies?
3) What shall I do if I still want to continue working with them but need other jobs in other companies to have enough income to pay my bills?
4) Am I entitled to gratuity? Because they didn't mention it.
