How to defend against a false abuse case?

My sister had registered a threat and abuse case against a person in Qusais Police Station, Dubai.

Yesterday, we met that guy by chance and he was again abusing us with his wife in his car. We got out of our car and asked him why he is doing that! He ran away in his car.

Today, I received a call from the police station that his wife has made a complaint against me that I threatened her and stopped her car on road to attack her.

She is claiming that the car was driven by another guy. In reality, the car was driven by her husband who is wanted by Dubai police for a case by my sister.

Now, they have submitted their car to Qusais police station to launch a fake case on us. They are doing this to create pressure so that my sister withdraw the case against her husband.

Can his wife register such a case against me?

What she is claiming is just null and void. Please ask your sister to keep going on her case. She shouldn’t give up as well.

Under Article 374 of federal law No.3 of 1987 in issuance of Federal Penal Code of UAE,

- "Punishment of detention for a period not exceeding 6 months or by a fine not exceeding 5000 Dirhams shall apply if slander or abuse is transmitted by telephone or face to face with the victim and in the presence of a third party."

However, you are required to produce adequate evidence to prove that the abuse occurred, by submission of proper witness statements, CCTV footages, and electronic communication to get a favorable judgment from the Criminal Court.

Regarding the counter criminal complaint raised by the other party, you will be given an opportunity by the Police to give your statement and produce witnesses to negate the other party's accusation.

If the case gets registered, you still have the opportunity to prove your innocence by producing evidence before the Prosecution and the court.
