Q: I purchased an apartment in August 2007 which was due for handover on October 31, 2009. The purchase price was AED 1.42 million. The payment term was 50% in 7 instalments and 50% on project completion. I paid 50% as per the agreement, The developer informed me sometime in 2008 that the project was delayed due to force majeure as the substation in Business Bay was not complete. Now it is 2020 and the project is still not completed. The substation in Business Bay had been completed years ago. I would like to know if I am entitled to compensation for the delay or can I cancel the purchase in its entirety and get my money back along with interest? Please advise me on my options and what steps should I take forward.

Q: I purchased an off-plan property studio in Mar' 2018 from a well-reputed builder in Dubai. The anticipated handover date was March' 2020. In Aug 2019, I received notice that there is a fire incident at the site. Same month Aug' 2019 I have cross-checked the project status on the Dubai Land Department website which shows only 23% of work has been completed. It was clearly understood that the project was running late & they were never in a position to complete on-time March' 2020 even if the fire incident would not have happened. In the month of handover Mar' 2020, we have received that due to force majeure the handover is delayed & the remaining monthly instalments are paused & will be taken on completion, paid 50% till now. As I understand from my contract, delivery can be pushed by up to 12 months, however, there is no mention of actual delay that can be taken on a note of force majeure. What are my options with the developer? My preference would be to terminate the contract and get my money back.

Q: I have invested in a villa and it's been 19 months that my villa is still not ready and I haven't got the possession or either copy of the contract which I have signed with them. How can you help in this regard?

Q: I left the UAE in December 2016. I have given a power attorney to my son. He was supposed to transfer my funds to me when I open a bank account in my new location. I moved to Canada. When I got my permanent residence and social number, I requested him to just send all money at once. At that time, NBAD became FAB and I have no access anymore. Unfortunately, my POA representative lied to me saying that it is difficult to deal with the bank as there are a lot of restrictions and all the money is safe and untouched. At the same time, he cashed out all the funds from the account. What legal action I can do now in this case? Thank you!

س: السلام عليكم، عملت زوجتي بشركة لمدة شهرين وصاحب الشركة خارج الدولة وما زال ولم يتم الإجراءات القانونية كموافقة العمل لأنها على كفالتي. وعد بالحضور للدولة ولم يأتِ فتركت زوجتي العمل معهم. خلال فترة الشهرين كانت تستلم أموال من مستثمرين مع الشركة وتحرر إيصالات استلام خاصة بالشركة. صاحب الشركة لم يُسلِّم الأرباح للمستثمرين وهم الآن يسعون خلفه ويتصلون بزوجتي ويقولون أنها استلمت أموالهم ويطالبونها بالضغط على صاحب الشركة لإرجاع أموالهم. ما موقف زوجتي القانوني هنا؟

The provisions of this Law supersede articles (2) and (11) of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.

This Resolution approves the Implementing Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.
