Trial in absentia for claiming a debt

Hello dear adv.

I have a case against a person to reclaim a debt, and I didn't receive any reply from the court yet because they can't find his address.

How long does it take before the case is considered time-barred? Is there anything I can do to prevent this and not lose my money?

Hello

All the measures you can resort depend on having access to your defendant. If you don’t have access to him or his properties, you can't use measures to secure your claim.

Civil cases don’t have a time-barred situation. In this case, you have to request to publish the court notice in a newspaper.

After a month, the court will hold and render the verdict. If they don’t find the defendant's address they will notify you on this, and then you have to change the address or present him as unknown.

If not, the court will reject the case.
