Abandoned spouse right of filing an abandonment case

Asalamu Alaikum

I am an Indian women married in the UAE to an Indian man. He sent me to India for my delivery and didn't give me any money for delivery.

It's been more than 5 months and still, he is not ready to apply for a visa for me and my kid. Whenever me or my dad ask, he says he is busy with work.

He is neither calling us from the  UAE nor giving us any money.

Can I put abandonment case on him? What is the procedure for it? Can I file the case from India?

Dear Questioner,

Wa Alikom Alsalam.

Hope my message finds you well.

First I would like to express my sadness regarding what I heard from you.

Second, you must know that the UAE federal law of personal status protects and saves all your rights, together with your kid.

Yes, for sure you can file abandonment case against your husband according to Sharia. Moreover, you will get all your legal entitlements for example (home expenses, monthly expenses, expenses of your kid's care... etc).

And in case you are going to file a case against your husband from India, I would like to inform you I am quite sure that you can do that probably through a law firm.

Please feel free to contact me on my mail "ms@elnaggarlegal.com"

Thank you.
