Liability of an employee for making a wrong payment
If in any case that our system was hacked, and by mistake, a payment transfer was done and sent to a wrong bank account which is the bank account of the hacker, will the one who sent the payment be liable to pay the amount transferred to the hackers?
Does the company have the right to file a case against the employee who made the mistake?
Dear Questioner,
Basically, your question touches a very common problem that occurs in our today's business world. Such crimes are on the rise.
Answering your question:
- The liability of the mistake happens when the employee does not follow the procedures for verification of the beneficiary and information provided to him in regards to the transfer he makes.
So, if there is more than one person responsible for the transaction, and none of them has raised any concern, then they should all be liable.
- Yes, the company has the right to file a case against the employee for negligence, or not following the procedures correctly, causing such damage/loss of funds.
I would recommend you to seek legal help if you are involved in such problem.
