طلب المالك زيارة العقار المؤجر عن طريق الوكيل العقاري

مرحبًا،

هل يمكننا رفض طلب المالك بإرسال الوكيل العقاري لزيارة العقار من أجل معاينته لأنه يخطط لبيعه؟

مع العلم أننا في ظل الظروف التي يفرضها فيروس كورونا. لدي طفل صغير وزوجة حامل.

أيضًا، ما هي فترة الإشعار التي يجب إعطائها لنا قبل أن نضطر إلى مغادرة العقار؟

Many thanks for your inquiry!

If a landlord wants his or her property back to sell it off, then at the start of a tenancy, the landlord must serve you with notice of that intention.

A landlord may also wish to move a tenant on by serving notice of a change to the tenancy terms at least 3 months before the end of the tenancy.

The terms may be such that the landlord knows for certain that the tenant cannot stay, will move out, which then frees up the property for sale.

In relation to visits to the property, a landlord has an absolute right to visit and inspect the property upon giving reasonable notice to the tenant.

This right cannot be taken away from the landlord. My recommendation to you is to cooperate, but at the same time, to know your rights with regards to the sale of the rented property.

Most property owners will sell with a sitting tenant and the balance of your tenancy terms simply passes on to the new owners.

Hi,

Thank you for your reply!

The owner can visit, but shall I accept real estate agents or bank representative to visit on his behalf?

On the other hand, I am confused about the months' notice, as I read online that it is 12 months notary notice.

My renewal is in May, and therefore if he informs me now, which he did by email only, I should actually leave by May 2021?

The law allows the owner or his representatives to visit the property upon giving you reasonable notice, you cannot block access.

The landlord needs to give you proper notice if he wants to sell, but as stated previously, he can easily get you out by changing the tenancy terms.

It is best to be cooperative with him and tell him that you wish to continue to live in the property and that you do not mind being a sitting tenant for the new owner.

This will help to factor those terms in when negotiating with buyers. The rental market is not good right now; most buyers will be delighted to buy the property with a tenant already in it.
