Filing a divorce case in Dubai and having daughter stay under father's visa

Good morning Mr. Ghosh,

I am 52 years old.

I am working in Dubai and am a sponsor for my wife (49 years old) who stays with me as a housewife. I have a daughter as well (19 years old) staying with us.

Can I file a divorce case here in Dubai due to marital disharmony and mistrust? What is the procedure?

After the divorce, can my daughter stay here under my visa?

Hi,

Yes, you can file a divorce case in the UAE. You need to file it in the Personal Court in Dubai where they will call for mediation to see if reconciliation is possible.

This step is mandatory. If the reconciliation doesn't work, then the case will be transferred to Court. Normally, it takes 4 to 6 months for a judgment in the First Instance Court.

Welcome!

We charge in phases. For example, if the matter is closed in the First Instance Court itself, we charge 15000 AED.

If there is an appeal, then we charge another 10,000 AED and if there is Supreme Court, then we charge another 5000 AED.

This is exclusive of VAT, court fees, and other expenses like translation, etc.

For the first court fees, we charge in two installments: first on signing the agreement, and second on the judgment.
