Q: Good day,
I am working in an LLC Company in Dubai with an unlimited contract. My scenario is as follows:
1. I am not paid salary for the last 6 months, haven't filed a case yet.
2. My visa and contract are finishing by the end of July 2019.
3. I got a job offer to join in August 2019.
4. My company is giving hope to give 2 months salary by 20 July 19.
5. The company is not paying the settlement to any while leaving.
Please advise me, can I leave this firm by the end of July and join the new offer without resignation and notice period?
My resignation will stop 2 months salary offered from them ( point 4 ).
Expecting a soon reply and thanking you.

Guaranteeing pending salaries and rights at the end of labour contract

Q: Hi,
I am Z. A.
My employer is not paying my salary for 3 months now plus another pending amount, and my contract is expiring on 8th May 2019.
I got an offer letter from another company and I resigned from my job.
My query is if my employer does not cancel me after one month or if he does not pay all my dues, what should I do to get cancelled and get my dues paid without losing the new job offer?
Please help me out.

Labor case for the non-payment of salaries

Q: Dear Sir,
I was working as a construction manager in one of the facade companies in Dubai for the last 2 years.
This company has salary delays during the beginning of my career and unfortunately, it worsened over the years and currently reached almost 10 months and I have to quit the company now.
The issue is that the above facade company took the employment visa for me from another company who was supplying labours (labour supply company) to them since the facade company can't provide visas.
Is there any way to claim my balance salary and end of service benefits from the facade company?
I have a copy of the contract between the facade company and my visa provider company (labour supply company) and NOC from this labour supply company.
Also, I have proof (emails and others) to prove that I worked in the facade company as their employee. Is there any other way if I approach any law firms such as yours?

صدر منطوق الحكم "بإلزام المُدَّعَى عليه بسداد مبلغ وقدره (.....) والفائدة القانونية (......) وأتعاب المحاماة (......)".
السؤال هنا عن إمكانية تحديد المبلغ المترصّد على مُدّعَى عليه واحد فقط؟ وكيف؟

Landlord's right to ask the tenant for overstay if he terminates tenancy without notice 0
Dear Mr Malalla,
I would like to get your opinion on an incident that I am going through at the moment with my previous landlord.
After staying in the same apartment for 4 yrs as a tenant, on 8/2/21, only a week before the renewal term (15/2/21) and after having a written agreement on a mutually agreed condition as well as sending us the contract, our landlord declared to us that he changed his mind and would apply the old contractual terms.
After having back and forth emails with our landlord's agency, on 23/2/21 we received the final email about his decision from the agency. As I did not want to stay in his place, we moved out on 6/3/21.
On 14/3/21, we received a quotation from the agency in regards to maintenance, which we mutually accepted on 15/03/21.
2 days ago, when I was waiting for my security deposit, I received a final calculation from the agency charging me the period between 15/2 to 5/3 as overstay. We reminded him many times of the rules and regulations but he does not care.

Steps to get the settlement amount from developer after cancelling a property 0
Dear Sir
I have cancelled the purchase of a property in Dubai and the developer has agreed with my decision. The developer committed in writing to refund the agreed settlement amount “within 90 days “.
I have kept consistent follow-up records and everything in writing between the developer and me. However, 1 week before the 90 days expiry period (due to my constant and persistent follow up in writing) the developer has stated it will take another 90 days for them to refund me the monies, sighting COVID-19 as “ the “ reason.
Am I able to enforce the email agreement between the developer and me to recover the agreed settlement within the 90 days and latest at the 90-day deadline?
I look forward to hearing from you, I would also be pleased to engage on the tel with you if you feel this would be more useful. I currently reside in Kenya.

اختصاص المحكمة في حالة وجود المدعي خارج البلاد 0
هل يجوز لمحاكم الإمارات الحكم بنفقة أطفال انتهت إقامتهم في الدولة قبل تاريخ رفع دعوى النفقات وبناء على إقامتهم مع الأم خارج الدولة؟
ألا يعتبر ذلك تعديًا على الاختصاص المكاني للمحكمة والأصل رفض الدعوى وإرجاعها إلى المحاكم المختصة في دولة إقامة الأطفال؟

مطالبة الشركة بالعمولة المستحقة بعد انتهاء مدة عقد العمل 0
أعمل بعقد محدد المدة ينتهي بعد ستة أشهر مع شركة مقرها الرئيسى دبي ولكنى أعمل بفرع أبوظبي ولذا فكل المرسلات عن طريق الايميلات من خلال الأوت لوك. فهل هذه الايميلات يعتد بها أمام المحاكم من عدمه؟ وماهو شروطها؟ وهل يحق لى الشكوى فى أبوظبي علماً بأن إقامتي دبي؟
فضلاً عن أنه لدي إيميلات تبين نسب العمولة في حالة تحقيق المستهدف كل عام ولكن الشركة تتهرب من تقديم كشف بالمحقق عن العام الماضي 2019 حتى تاريخه وترفض إعطائي بيان به حتى تتنصل من دفع العمولة ووصل الأمر أنني حققت للشركة عقد بمبلغ كبير يفوق الهدف (التارجت) بأضعاف وتحاول الشركة التنصل منه وتتلاعب حتى لا تقوم مرة أخرى بدفع عمولتي لهذا العام 2020.
ولهذا السبب فوجئت بالشركة اليوم بتوجيهها إنذار لي بسبب سوء السلوك ولم تبين سبب ذلك أو تجري أي تحقيق وبهذه الصيغة فقط فكيف يتسنى لي أن أحمي نفسي من ضياع حقوقي؟ علماً بأن طبيعة مجال الشركة تستلزم أن العقد الذى وقعته يتم توريده فى شهر أكتوبر المقبل.
هذا فضلاً عن سوء المعاملة لإجباري على الاستقالة، فهم يعلمون أنني لن أجدد العقد معهم ولذا يحاولون مضايقتي حتى أستقيل أو يقومون بإقالتي وحرماني من حقوقي.
أرجو النصيحة وشكراً مقدماً
