Q: Hello. We are an oil services company registered outside the UAE, dealing with a UAE-based company that keeps postponing the shipment of our order. As a result, we bear penalties due to the delay per day as per our contract with our client. Is there a possibility to file a lawsuit against the UAE-based company? Q: We had a commercial case from our client after he breached the agreed completion period. He claimed more than what he has paid as an advance and we have proved that the work is done close to the advance received. The court has given the judgement to pay back part of the advance received against the work completed but we are not happy with the judgement as we have incurred losses due to the extended execution period. During the court sessions, we have defended ourselves for the claims made by the client and we haven't been to the court of cassation. Referring to the res judicata, can we open a new case for the damages incurred along with the loss of profit for the termination of the contract as he delayed the project beyond the agreed execution period? We are in the process of seeking a refund from our supplier (an LLC in Dubai) to recuperate funds from deposits we have paid for stock that we have never received. The total credit we have with the LLC is USD $68,030.62. This is split across 2 orders; the first purchase order is dated 4th March 2021, and payment was made on 9 March 2021, totaling USD $29,217.50. We then issued a second purchase order dated 26th May 2021, and payment was made on 3 June 2021, totaling USD$38,473.12. Total payments and credit on 3rd June 2021 were USD $68,450.62. The total goods received on 3 June 2021 were USD $420.00. Total owed to [------Ltd] on 3 June 2021was $68,030.62. This was delayed until November 2022 and is still not ready, we issued a formal order for cancellation on 14 December 2022.

Q: My labor implementation case is currently in progress. Despite taking several steps, such as inquiring about the bank account and blocking the traffic file, my employer has not responded and disregarded the court's decision. As a result, I requested a travel ban, and the court accepted my request. Now, the employer is actively working to lift the travel ban. The UAE Penal Code, like all other laws, addresses the crime of fraud in Article 399 of the UAE Federal Penal Code, which stipulates that whoever seizes, for himself or another, a movable property, or obtains a document or signature thereon, cancellation or destruction thereof or amendment thereto by fraudulent means, or by assuming a false name or capacity, where such an act leads to deception of a victim and leads him to surrender shall be punished by imprisonment or fine.

This Law applies to merchants, as well as to all acts of commerce carried out in the UAE by any person even though he be not a trader. Commercial matters regarding which specific Federal laws are issued shall be subject to the provisions of such laws, and to the provisions hereof which do not contradict with said laws.

The provisions of this law, promulgating UAE Civil Code, govern the civil transactions in the United Arab Emirates. The commercial transactions remain subject to the laws and regulations applicable in their regard.
