العواقب المترتبة على رفع قضية طلاق فيما يتعلق بالنفقة والمهر

مرحبًا،

أنا متزوجة من رجل إماراتي يريد أن يطلقني، لكنه لا يريد أن يدفع لي المهر المذكور في عقد الزواج في حالة الطلاق.

يريد مني أن أطلب الطلاق لأنه في هذه الحالة لن يكون مُلزمًا بدفع المبلغ المذكور في عقد الزواج.

ليس لدينا أطفال. أنا من رومانيا وتزوجنا في إمارة دبي. أريد الطلاق أيضًا لأن زواجنا لم يعد ناجحًا بعد الآن ولكنني لا أعرف ماذا سيحدث فيما يتعلق بالنفقة المستحقة لي في هذه الحالة.

يرجى إخباري بشأن الإجراءات التي يجب علي اتخاذها.

But I want to know if I will still receive the dowry if I’m the one who will ask for a divorce, or in this case he doesn’t have to pay anything?

And what will happen with my visa cause I don’t have a job? I’m a housewife so my visa is under my husband.

You have the right to get maintenance from your husband, so first of all, you should approach the family guidance section of the personal status court for your rights.

Further, if you wish to divorce him; to take “Khula”, in that condition he can demand a waiver of the "Mahar" from you.

Mahar is your right.

Please read the specific Article for Khul in the UAE Personal Status [Fed. Law 28 of 2005]:

Article 110:

1. Khul (redemptive divorce) is a contract under which the spouses mutually agree on terminating their marriage contract for some consideration paid by the wife or another person.

2. The portion that may be specified in the dowry may be specified in the Khul compensation, but it may not exclude the children's maintenance or custody.

3. If the Khul compensation is not valid, the Khul shall be valid and the husband shall be entitled to the dowry.

4. Khul shall dissolve the marriage contract.

5. By way of exception from the provisions of clause 1 of this Article, if the husband refuses the Khul due to obstinacy and it is feared that they may not observe the limits ordained by Allah Almighty, the judge shall decide this Khul for some proper compensation.
