Q: I want to prepare a statement of defence over a bounced cheque in Abu Dhabi.
What are the main points that I should include and the main points I should exclude in the statement?
I cannot afford lawyer fees as I earn less than AED 5,000 and most lawyers want above AED 10,000.

Labour complaint and liability of the employer

Q: My husband filed a labor complaint in court and the demand was 200,000 AED including the delayed salary (6months)+gratuity+reimbursement claim for medical insurance under company + immigration fine due to the failure of renewing his visa.
The court judgment is only 46,000 and his salary as per contract is 9,000 while the current salary where most of the delays were made is 12,000 AED.
What is the basis of judgement in your opinion? Did they base it on BASIC SALARY for the delayed + gratuity? Do we need to appeal against the court decision, because we are afraid that we might lose even this money as we cannot afford to hire a lawyer?
Moreover, we paid the immigration fine of 10,000 AED from our pocket as they said it has nothing to do with the case. Can you please enlighten because of what his company did to us lead us to lending money and we are expecting at least to get the 6 months full salary + gratuity and the fines that we pay for overstay due to this company.

Right of the lawyer to claim unforeseen fees from the client

Q: I hired a lawyer for debt recovery of 25,000 and they charged me around AED 10,000. AED 3,800 for the legal notice, and 1800 for negotiation, then 4000 for the settlement and exchanging a few more emails.
Is that a reasonable amount as they claim?
Their last charge was not communicated ahead as they claim they couldn't anticipate the work ahead.
Do I have any right to complain or reject that last charge?

Preparing for a court hearing of a labor case by an employee

Q: Hello,
I have a few questions:
1. My first court hearing date is set for my labor case, has the employer been notified by Dubai court of such?
2. I have a remote hearing case in 2 weeks' time, how do I request a translator for the remote hearing beforehand?
3. I have already submitted all documents, what do I need to submit during the first hearing?
4. Will there be access to listen to what was said during the session after the court session is over?
5. In the event the employer does not attend the hearing, will they postpone or continue as normal?

Non-payment of share value and claiming the shares back 1
My company is located in Dubai as an LLC. We have two shareholders,
1. UAE national shareholder with 95%
2. A foreign shareholder with 5%
The UAE national shareholder transferred this 5% shares to the foreign shareholder through a share sales agreement, which was notarized at the notary public in Dubai and submitted it to the DED to amend the trade license etc. This happened in 2014.
But till this date, the foreign shareholder did not pay the value of 5% shares to the UAE national shareholder or to the company.
Also, the foreign shareholder was not actively involved with the company's operation and as per Article 17 of the Commercial Companies Law:
"2. The partner may not contribute in work rendered unless he is a joint partner. The contribution of the partner may not consist of his having reputation or influence."
Under these circumstances, is it possible for the UAE national shareholder to request from the court to cancel the 5% shares of the foreign shareholder and transfer back to him?
