In this regard, I wish to understand whether under the UAE laws an employer can enter into a contract with a subcontractor. Or can the contractor only enter into a contract with the subcontractor? Q: Our company paid approximately 85,000 AED as advance (for commercial rent) to a developer whose project never got completed. The handover for the site was 1.5 years ago! We have been requesting a refund since many months now but the landlord/developer is not cooperating. The payment was made via cheques and the lease had been signed as well. Further, I have seven sent them a legal notice two months ago via Dubai Courts but there has been no reply from the developer. May I know what could be done next?

Q: A Sub-Contractor (SC) holds/stops the work highlighting Article 246 & 247 [UAE Civil Code] due to payment delayed (Advance & Interim Payments) by the Main Contractor (MC). But the Main Contractor's concern is the document required to process Advance Payment [i.e. Advance Bank Guarantee - ABG] was not submitted on time & LC draft issued to SC was not agreed on time due to several arguments on some of its content. The MC paid the SC Advance Payment in 90 days from receipt of ABG highlighting the delay in reallocating the fund due to delay in ABG submission & LC draft agreement. Whose argument will withstand moving forward if MC intends to impose delay penalty on SC? Please advise. Thank you

س: السلام عليكم، طلب مشورة من ذوي الاختصاص. لديّ شقة في مشروع عقاري، وحسب العقد المبرم أدفع ٤٥٪؜ من قيمة الشقة في أثناء البناء على تواريخ متفق عليها من قبل الطرفين و٥٥٪؜ عند الاستلام. ذُكر في العقد موعد الاستلام في شهر ١٢ من سنة ٢٠١٩، ولكنني دفعت ٢٥٪؜ فقط وأوقفت الدفع التالية في بداية ٢٠١٩ لأن المشروع كان متوقفًا تمامًا وبعدها جرت عدة اتصالات مع الشركة المذكورة حول سبب وقف العمل بالمشروع لأني لست مقيمًا في دبي والآن يطالبونني بسداد الأقساط المتفق عليها بقيمة (٢٠٪) مع غرامة لأنني أوقفت الأقساط بمبلغ ١٢٠ ألف درهم إماراتي. اتصلت بهم وبعثت عدة إيميلات ليحذفوا الغرامة وكان الجواب بالرفض بحجة التأخُّر في السداد. إذا كنت متأخرًا في السداد، فهم أيضًا متأخرون في تسليم المشروع وهو ما برروه بأن لديهم عذر في ذلك. طلبت منهم أيضًا دفع ٣٠٪؜ لغاية التسليم وبعد التسليم ٧٠٪؜ وأيضًا رفضوا. حاليًا ليس لديّ ثقة في هذا المطوِّر لأن تعاملهم ليس سلسًا مع العملاء. هل هناك طريقة لفسخ العقد واسترجاع أموالي التي دُفِعت لهم؟ أو، أضعف الإيمان، هل هناك تعويض بسبب تأخرهم؟ مع خالص شكري واحترامي!
