Q: Ramadan Kareem!
I am working in retail with an unlimited contract. Last March, my income has been reduced by 20% due to the company's internal restructuring.
Unfortunately, the COVID-19 pandemic got even worse forcing me to be in furlough. They have reduced my income by 80% until 3 months.
At the same time, the company had asked to donate some of the Annual Leave days to help the company during the crisis. Is this legal?
The company is going to put me into redundancy soon and they have advised that it will be only for a month instead of the 3-month compensation.
Kindly advise.

Obligating an employee to accept unpaid leave and his resignation upon refusal
0
Q: I've been working in a company in JLT under a limited contract for a year and a half. Due to the current pandemic, I was asked to sign a letter stating that I am going on unpaid leave for 5 months which I did not sign.
I did explain via emails that I can not accept to live without any income for 5 months. I said that I accept salary deductions. I did not hear from them except that they are waiting for my signature for unpaid leave.
I will most probably have to leave Dubai because I can not afford anymore to live here. What are my rights in this case? Can I resign because I haven't received a salary last month? Am I entitled to any end of service benefits in this case?
Am I obligated to pay any penalty because I am resigning under a limited contract? What can I do if I don't hear from them by the end of this month or if I don't receive anything at the end of the month?
Thank you!

Staying in work accommodation till a judgment of a labor case is issued
3
Q: My company gave me an early retirement with one month's notice on 5th May 2019 after 20 years. A settlement is not done.
My visa has already expired on 16 of July 2019. Then, I filed a case in Sharjah court, and a judgment came in my favor on 30th October 2019.
I am waiting for the money that the company has to pay. I am staying in company's accommodation. Now, the HR called me today asking me to leave the flat and pay (1000 Dhs./month, starting from June) to the accounting department.
So legally, can I stay in the company's accommodation till I get the money? And as I said, my visa expired so can I stay legally in the UAE till getting my money from the company?

View allHow to expedite the process of sending a judgment issued in the UAE to another country? 0
Hello,
There was a bounced cheque case against me in Dubai in 2009-10. I won the case upon appeal in January 2020. I have been fighting extradition to Dubai since 2018 for the same case.
Even though, the case was won in January. Until today (December 2020), the authorities in my country of residence (Ukraine) haven't officially received the judgment from the UAE.
1.What steps can be taken to expedite this process?
2. What steps does a judgment go through before it is communicated to the country in which the extradition case is pending?
3. What is the normal time frame for this process and for the removal of the Interpol red notice against the accused?
Thanks and regards,

The developer failed to rectify the numerous leakages in the apartment, what to do? 0
Good afternoon,
I have purchased a property in Al Barsha (top floor). In spite of repeated reminders, the developer failed to rectify the leakages (numerous) in my apartment.
I had also notified this during DLP (Defect liability period). Can I refer my dispute to Rental Disputes Committee in Dubai Courts, even though there is an arbitration clause in the Sale and Purchase Agreement?
Appreciate your guidance on this.
Kind regards,
Kalpesh

The penalty applied when resigning before the expiry date of a limited contract 0
Dear Sir,
I am working with Jafza company as a product development manager under a limited contract.
Today, I am giving my 30 day-notice period against my contract. My contract will end by July 2021. I heard that I need to pay 45 days' salary to the company because of contract breaching.
I would like to know:
1) If I am giving an advance 30-day notice period, then why should I pay 45 days' salary to the company?
2) Currently, am I not doing my job as per Jafza attested contract?
3) After a year, the company changed my job profile without any amendment in Jafza attested contract?
I look forward to your valuable feedback.
Best Regards,
S.D
