Cancelling the visa of an employee who filed a false complaint

I needed some information in regards to visa cancellation. One of our employees filed a false complaint with DDA (Dubai Development Authority) to stall the visa cancellation.

He is not on our payroll since July 2019 and we are not able to cancel his visa because of his dependents. We have filed for absconding with MoL and is still pending as there is this an ongoing dispute.

Can we file a case against the employee for defamation?

He is trying to mislead the authorities and extort us.

Hello,

The employee has filed a complaint with DDA.

First of all, you have to write and contact DDA, since we presume that your company is under DDA and oppose the application made by the employee.

As DDA is guided by the UAE Federal Labour law, hence all the provisions of the Law will be applicable. In the procedure for visa cancellation, you have to follow the step by step procedure as per Labour Law.

However, since the visa cancellation is halted due to the complaint, thereby it is necessary to file a labour case which should be filed by the company on whose payroll the person was.

Then in order to file for defamation there needed to be certain specific evidence or related NDA agreement if any or any sort of proof that the employee is causing you harm.

Yes, always any case can be filed against the employee but with proper proof.
