Claiming a debt from a client in Dubai by a UK company

Can we file a civil case of debt recovery with the client in Dubai from the UK or do we have to carry recovery procedure only with Dubai court?

Hello,

The debt recovery process will have to be carried out from the relevant Dubai courts, after serving a legal notice.

Please note that if through the legal notice a settlement is reached, there will be no need to initiate a court case.

We're a UK based company but one of our clients is in Dubai who did not pay for our invoices for a long time. So where should our court proceedings be, in Dubai or in the UK?

As your client is based in Dubai, therefore, the civil case for recovery should be done in Dubai.

May I know what is the duration of serving initial legal notice we sent to them, in order to initiate case proceedings.

Once the legal notice is served, the case can be filed within a week's time (Max).

As per the UAE laws, court fees are 100% claimable, and a part of legal fees from the client.

As per UAE laws, it should be in Dubai so that the judgement can be enforced later on.

Taking judgement is not always important, you will have to enforce it to the client so that he pays under all circumstances.
