Settlement in a bounced cheques case and removing jail sentence

A friend of mine has a few criminal cases in Dubai for bounced cheques. The complainants of his bounced cheques are individuals.

Criminal cases have been filed and a sentence of jail term has been imposed by the Dubai Court in Absentia. He would like to know the following:

1) If he reaches the settlement with the complainant, can the jail term be removed?

2) In some instances, if the complainant is not in Dubai anymore, then how can the settlement be reached in order for the jail term to be removed?

Please advise.

Thank you.

Dear Questioner,

Please check my answers as follows:

1) Yes, If your friend gets a settlement or waiver letter from the complainant the cases will be released.

2) The complainant should notarize and attest a waiver letter from the country which he lives in and send the original in order to submit to the judge.

For any further inquiry, please feel free to contact me by calling or at my email address.

Thanks.

Dear Mr Mohammed,

Does the settlement mean the amount can be less than the bounced cheque amount agreed with the complainant?

Question No 2 is if my friend is unable to locate or contact the complainant and if the complainant is no longer in Dubai, then how can it be settled?

The settlement is either a reduction of the total amount or waiving the remaining amount to be zero.

If you're stuck to reach the complainant, please feel free to contact me.

Thanks.

Dear Mr Mohammed,

My friend would like to know as he is not in Dubai. Without his presence in Dubai, can the settlement be made with the complainant to remove the jail term and the case?

Please advise.
