التعويض عن إنهاء عقد عمل محدد المدة من جانب صاحب العمل

لقد كان زوجي يعمل بموجب عقد عمل محدد المدة. أبلغته الشركة أنه تم إنهاء خدمته لأنهم لم يعودوا بحاجة إلى خدماته.

لقد أكمل سنة واحدة في 30 مارس 2020. أبلغته الشركة أنه تم تجديد عقده حتى ديسمبر 2020 وأنه عمل حتى 30 أبريل 2020.

في 30 أبريل 2020، قاموا بفصله. وطلبوا منه قضاء فترة إشعار حتى 30 مايو 2020.

هل يجب عليه قضاء فترة الإشعار وما هي المستحقات التي يحق له المطالبة بها؟

Dear questioner,

As the reason for your husband's termination is not related to his performance, therefore, it can be treated as arbitrary dismissal wherein he can claim salary up to 3 months in lieu of arbitrary dismissal.

The limited contract can not be terminated before completion. If the contract is not finished, this is an illegal termination.

Secondly, in such a situation, the employer should pay a salary of 90 days as per the UAE labour law.
