Q: My husband has divorced me and now he wants the custody of the son through Sharjah court. I am an Indian and I want to solve this issue in India, what will happen if I do not reply to the court order of Sharjah. I don't want to go to court here as the law in my country is different. even though I am a Muslim.

Q: I am a Hindu married in India in Dec 2017. I came immediately to Dubai with my husband who is an NRI born brought up in Dubai. Soon I was pregnant, was sent to India for abortion against my will around Jan 2018. How can I stay now, even forcibly, with my husband in Dubai? My inlaws who are hand in glove in the matter with my husband say that it's their house and will permit only their son, not his wife. In such circumstances, what are my available options to legally force myself to stay with my husband? No divorce petition is filed as yet and I will never give a divorce to him.

Q: Asalamu Alaikum I am an Indian women married in the UAE to an Indian man. He sent me to India for my delivery and didn't give me any money for delivery. It's been more than 5 months and still, he is not ready to apply for a visa for me and my kid. Whenever me or my dad ask, he says he is busy with work. Within the framework of judicial collaboration, India and the United Arab Emirates (UAE) entered into an agreement in October 1999 on juridical and judicial cooperation in civil and commercial matters for the service of summons, judicial documents, commissions, execution of judgements and arbitral awards (the 1999 Agreement).

As the bilateral relations between India and the United Arab Emirates have witnessed a rapid growth in the recent past, and to further augment their strategic partnership, the Central Government of India has on January 17, 2020, declared the UAE to be a reciprocating territory for the purposes of Section 44A of the Code of Civil Procedure, 1908 (CPC).

The law promulgates UAE Civil Procedures Code (Civil Procedure Law) which governs civil procedures in the United Arab Emirates, including the prosecution before the courts, litigation and execution.

UAE Personal Status Law (also known as Personal Affairs Law) governs marriage, divorce, inheritance and other personal affairs in the United Arab Emirates. The law equally applies to citizens of the UAE and non-citizens unless one of them asks for the application of his home country law.
