Application of Resolution No 279 of 2020 on Freezone companies

My husband was employed with a Dubai Freezone company and has been made redundant with a 90 day notice period. Due to the current pandemic, it is difficult to travel because flights have been grounded. He can't either find another recruitment.

My question is that is the Ministerial Resolution No 279 of 2020 applicable to a Dubai Freezone company and is the company liable to pay HRA even after the termination of employment?

In and of itself, Ministerial Resolution 279 of 2020 ("Resolution") may not apply to free zones. The Resolution's language states that it applies to companies under the Ministry of Human Resources and Emiratisation ("MOHRE").

However, certain free zones have made themselves subject to any regulations issued by, or for, the MOHRE.

Alternatively, other free zones have issued decisions either adopting the Resolution or with similar implications to it. It may be worthwhile checking with DAFZA to inquire about the same.

I would request you to check with DAFZA authority about your issues related to HRA as Freezone companies are not governed by MOHRE.
