تأخير تسليم وحدة تحت الإنشاء وطلب التعويض

أريد منك شرح هذا البند في اتفاقية البيع والشراء الخاصة بي.

أمتلك وحدة تحت الإنشاء وكان تاريخ الانتهاء الأخير (عند التوقيع) 29 فبراير 2019. ومع ذلك، أبلغوني أن تاريخ الانتهاء الجديد سيكون في شهر أبريل 2020. وفي مارس 2020، أبلغوني أنه سيتم تأجيل التسليم حتى شهر نوفمبر 2020.

''يجب على البائع قبل تاريخ الانتهاء المقدر إخطار المشتري بتاريخ الانتهاء المحدد للوحدة ("تاريخ الانتهاء''). ويجوز للبائع، وفقًا لتقديره، وبعد إرسال إشعارًا إلى المشتري قبل شهر واحد على الأقل من تاريخ الانتهاء، تمديد تاريخ الانتهاء إلى تاريخ آخر كما يرى البائع من وقت لآخر شريطةً ألا تتجاوز الفترة الإجمالية لهذه التمديدات 12 شهرًا من تاريخ الانتهاء الأول المحدد، إلا في حالة القوة القاهرة."

يرجى توضيح ذلك وإخباري هل يحق لي الحصول على تعويض بعد التسليم أم لا؟

أو حتى استرداد أموالي بنسبة 60% من قيمة العقار التي دفعتها لهم.

As the wordings mentioned above, the developer can delay the handover of the project for a period of 12 months from the date of handover.

If the project is delayed beyond this period (after 12 months), then you can ask for compensation for delay in handing over of the property.

So is the handover date I have to refer to April 2020 or Feb 2019? Because if it’s Feb 2019, they have exceeded the 12 months.

The handover date is Feb 2019, an extended period (after 12 months extension) is April 2020.

They have the right to extend the completion date for another 12 months, it means that after 29 Feb 2020 you can terminate your agreement and recall back your paid 60%, plus all fees paid and loss (including damage and compensation for holding your fund till the date of termination plus interest).

Dear questioner,

Please note that the seller has notified you with more than 12 months as mentioned in the SPA, however, you still not entitled to sue him right now in order to claim the money because the second notice they sent you.

We recommend you to wait until the first of October, then we can send them notarized legal notice in order to ask them to hand over the apartment or return your money back and terminate the SPA.

If you will register your case now, you might be facing rejection from the court as the seller already notified you.
