الاستقالة خلال فترة الاختبار والتعويض في عقود العمل محددة المدة

مرحبًا،

أريد الاستقالة من الشركة التي عملت بها لمدة ثلاثة أشهر تقريبًا. ما زلت في فترة الاختبار التي تبلغ مدتها ستة أشهر.

لقد عرضت قضاء فترة إشعار مدتها شهرًا واحدًا في خطاب الاستقالة. إنني أعمل بموجب عقد عمل محدد المدة. هل يحق لصاحب العمل الحصول على تعويض أو إصدار حرمان ضدي من إدارة الهجرة؟

Dear questioner,

Thank you for your query. A limited contract can only be legally terminated in three ways: If the term of the contract expires and is not renewed, if the employee and the employer mutually agree to end it, or if the worker commits any of the violations mentioned under Article 120 of the Labour Law.

Since you terminated your limited-term contract before the expiry of the term but during the probation period, you will not be liable under the UAE Labour Law to pay the employer early termination compensation. However, the employer would have the right to impose a labour ban for a period of one year.
