إنهاء عقد موظف دون إنذار مسبق أثناء تواجده في بلاده

أنا مواطن نيوزيلندي، تم تعييني بواسطة شركة مقرها إمارة دبي للعمل في أربيل.

بدأت العمل في ديسمبر 2019. واضطررت للعودة إلى الهند في أوائل فبراير 2020 لأن حالة والدتي كانت سيئة.

عدت إلى أربيل في الثالث من مارس. عندئذٍ أخبروني أنه تم إنهاء خدمتي.

خلال فترة عملي، لم أستلم أي إشعار كتابي من الشركة التي مقرها إمارة دبي أو من العميل.

الآن ترفض الشركة دفع:

أ) تكاليف تذكرة العودة.

ب) تكاليف إقامتي في أربيل بسبب الإغلاق الذي فرضه فيروس كورونا.

يرجى إخباري ما هي الإجراءات الواجب علي اتخاذها؟

Dear questioner,

I think the best option for you is that you send legal notice to your company advising them that they have to pay you the benefits and dues and reserve your right to claim compensation aiming to settle this as soon as possible rather than waiting and go to labor court in Dubai.

Try to reach a settlement with them, if not then you can attend later to Dubai and file case against them.

As you mentioned that you are working in Iraq, therefore can you check what kind of contract you have signed with the Dubai based company?

If there is a labor contract registered in UAE ministry, then you can file a labor complaint in UAE otherwise, based on the contract, you have to file a Civil case in UAE courts.

You are hired in Iraq as I think so you should check the labor law of Iraq and can register your grievance there.
