The process of visa transfer and sponsoring family members

Hello,

I am sponsoring my baby (10 months old) and my Filipino nanny. I am switching jobs shortly. My current visa will be cancelled in July and my new one will be activated in early September.

Can you please explain where this leaves us in terms of the period in which I have no visa and my baby and nanny have no visa. (Can we leave the country and return during this period?)

Any advice would be greatly appreciated.

Hello,

Thank you for your question.

Once your visa is cancelled, you will have a grace period for 30 days to amend your status and get another residence visa or leave the country. There will be no fines during the grace period.

If you overstay after the 30-day grace period, the following fines will apply:

- AED 125 for the first day

- AED 25 for each subsequent day

- AED 50 per day after six months of overstaying

- AED 100 per day after one year of overstaying

Something to also keep in mind during this time is that the UAE issued an announcement that there will be no fines for the duration of three months for all UAE visas that have been expired.

Should you require further tailored substantive legal advice, kindly contact my firm by phone or email.

Regards,

Ludmila

Thanks for the swift reply.

Can I "switch" my dependents visas over to my new visa or will I have to cancel their current ones and reapply once I have my new visa?

We are pleased that we were able to assist you.

Generally, your dependents' visa will be linked to your visa and not directly linked to your employer.

As such, if you are transferring your visa within the same emirate, then your dependents' visas should be placed on a temporary hold until you move to your new visa.

Following, theirs can be switched to your new one without cancelling and re-applying. However, this may differ if you are switching to a new emirate or from a free zone to the mainland.

Dear Questioner,

There is a holding of visa, if you are changing visa between two companies, you are not required to cancel your daughter and nanny visa while you are changing visa.
