Q: Hi Sir.
Hope you are doing well.
I came to Dubai on a visit visa in 2014. I got a job and the owner of the company asked me for money to issue the employment visa. I paid him the amount, but the employer didn't apply for my visa and went to his country.
I filed a case against him in the court, but he didn't come to the court after he returned to Dubai. The main problem was that I had given him my original passport, and that's why I didn't exit the country.
After 10 months, I went to Al Aweer jail and I took exit without paying overstay fine. I had given fingerprint and eye scan also. Now, I want to come back on partner visa and I want to know if I can come on that visa or not.
If you help me on this matter, I will be very thankful to you.

Consequences of non-renewal of visa and labour contract

Q: Kindly advise what can I do now that my visa already expired (expiry date is 04.04.2019). I keep waiting for my boss to have it renewed as he promised it will be renewed.
The grace period is already finished and at this time, I have not received his advised for renewal yet. My labour contract is also not renewed.
I am still working with them but I feel like somebody will just catch me as at this time I know I am over-staying. Is filing a resignation and complaining to labour the solution for my situation?
I also have a credit card that I agree for a settlement a few months back, but since our salary is always delayed, the bank said they will cancel the settlement and will file a case.
How can I check if I really have a case now? Can the police just put me in jail?
Hoping you can somehow give me advice.

How to cancel a partner visa while another partner is absconding

Q: My brother and I are partners of a company in Dubai. We filed a case against our third partner who was the owner of the established company in 2014 and his wife was a partner.
He cheated us by showing a fake business/profit proposal. He made us partners also in October 2017. We were never involved in the business and we are Abudhabi residents.
We filed a case in Feb 2018 when we realized he did not invest our money as our agreement. From then on, he is missing. Now our partner visas’ have expired (Nov 14th) and he is still absconding.
We have a judgment against him and ongoing execution for our case. He also has a travel ban and an arrest warrant. We need to cancel the visas so that we can apply for another new visa.
I am in the UAE and my brother is outside UAE. It has been three months now.
Need sincere assistance!

I overstayed in the UAE for almost 13 months in 2021 and was held by Ajman immigration and sent back to Pakistan.
At the time, I was on a partner visa from Sharjah Shams Freezone which had expired. Now, I want to return to the UAE and need to know if there is a travel ban or restriction on me entering the UAE.

We received a cheque which has now bounced. We have tried for over a month and a half now to get a new cheque from the person, and every day he says the next day.
We need the money now. We have been to the police station, and they said they can not do anything as the reason the cheque bounced is "Insufficient funds."
We have been to Al Barsha - Dubai Courts, and they said there is nothing they can do about it.
We are not sure what we can do. We need the money asap to pay our kids' school fees, let alone all the interest we have lost.

After 11 months of work, how many leave days is an employee entitled to? 0
Hello,
I want to inquire regarding my leave privileges. I am now 11 months in my company. How many leaves am I privileged to?
Based on Decree-Law No. 33 of 2021 regulating labour relations and its executive regulations, you are entitled to a paid weekly rest for not less than one day, as specified in the work contract or the work regulation.
The Council of Ministers may increase the weekly rest day stipulated in this article. The Decree-Law and its executive regulations also stipulate that you are entitled to an annual leave with full pay as follows:
- Thirty days for each year of your extended service.
- Two days per month in respect of any employee with more than six months and less than one year of service.
- Leave for parts of the last year of your service in case it is terminated before you use your annual leave balance.
Now my question is: do I have 22 days I can use? Can someone explain to me in detail?

What can I do if I got a judgment in absentia for selling medicine without a license? 0
I got an order of 6 months imprisonment and deportation for a judgment in absentia by the Sharjah court for selling medicine without a license. I was not involved in the case directly; my friend used my car, and he had my bank card.
They made a confession that they were working for me and made a false claim that they had transferred money to me. As I am outside the country, I came to the UAE to solve my case.
I got detained at the airport, and the CID asked me some questions. I mentioned they didn’t transfer me a single Dihram, so he let me go, as the case was already open for appeal.
In the first instance court, they gave me the same verdict, then I appealed and attached documents like bank statements and my company details, which were not mentioned before.
They gave a date for the judgment, but it was not issued, and they gave the next date. I have been suffering a lot for the last 3 months here in the UAE and for 6 months back home.
So my question is that what will happen next?
Will the case be open for retrial, and will the CID be convinced by my logic?
Can they drop charges, or now the court decide only?

I bought an off-plan property from a developer in downtown during the peak time. My payment plan was based on construction with completion being Dec 2019. I have paid more than 50%.
I requested the developer to readjust my payment plan as the project is delayed. They moved on payment forward and sneakingly changed completion date to Aug 2021 in the document. The SPA still says Dec 2019.
Now I'm struggling to pay the next payment due to COVID-19 and project is completed 56% as par Dubai land department and 60% as per the developer. The developer is asking for payment and calling me every day.
My question is can I still use the delay in the project as a clause to cancel my unit?
Can I cancel my apartment and how much can the developer deduct?
After selling me, the developer started offering customers post-handover payment plans for 4 years, which is very unfair as even if I complete my payment, no one will buy from me as the developer is selling something with 4 years post-handover.
Can legal help be provided in this regard?

I am a health professional in Canada.
Years back, I posted my CV to work in the middle east on a job site in the gulf. Last week, I got 3 emails claiming from a general hospital in Abu Dhabi, a hospital Dubai and another medicare hospital in Dubai for online recruitment.
they showed interest in my CV. All emails were from free accounts (gmail.com address). I chose then to forward an email to the concerned HR department of the concerned hospitals.
I forwarded one email to the official email of one of the hospitals (as given on the hospital site). They replied and said, yes, the email is legitimate and you can apply with confidence.
Now I got an offer letter from Dubai hospital with handsome salary offer but from a Gmail address. They're asking me to start position in one month only and asking to contact a travel agency based in Dubai.
Is it a scam or true? I have forwarded the email to the HR department of the hospital to determine authenticity.

Can a developer change the layout of the building as shown at the launch event and part of all brochures/online advertisements/model under the pretext that the same is not included in the SPA?
For the launch, we got convinced with the building design and layout but at delivery, it’s changed without prior intimation.

Inability to continue paying the installments of a property because of COVID-19 5
Hi sir,
I live in the UK. I am an investor and a broker for a property development company. One of my customers bought an off-plan property from it i.e just Cavalli Villa 2 years ago. 33% was completed and handover is due in 2021.
My client paid part of the deposit around AED 390000 (£80000) and she has been paying to the project for the last two years until early this year when COVID- 19 hit the UK. Since then, she has been ill and lost her job and, therefore, she is unable to pay.
My customer received a letter from the company saying that if the outstanding amount is not paid within 30 days, then they will take her to court. They say that they would cancel her plot and she will lose all MONEY paid so far.
My client needs payment delay until her situation improves but this request has been declined. The money secured under the ESCROW account. Can the developer have the power to take money from the escrow account?
What is her right under Dubai law? Can she do anything to avoid court order? The UK is in lockdown at the moment with no proper or normal banking functions.

Bank filed a civil case over a loan: Better to settle with the bank or in court? 1
Good day, Sir,
I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019.
I cleared the cheque bounce case earlier with a court fine in 2019. I am looking forward to a minimum settlement plan with the bank. The outstanding amount was around 70,000 AED, and now the message is for 115,000 AED.
What will be the best way for me to proceed: approaching the bank or dealing with it in court?

I worked at a bakeshop here in Dubai. I resigned exactly one year ago. Now they want me to pay for visa charges, as stated in the offer letter.
If I cannot pay for the charges, my employer will claim financial loss due to the damages, estimated to be at least 7,000 AED.
