استرداد دين شخصي دون اتفاق مكتوب

مرحبا.

أود أن أستفسر عن المبلغ الذي تحاسبون عليه مقابل استشارة لأنني بحاجة إلى بعض المساعدة القانونية فيما يتعلق بأموال قد أقرضتها إلى شخص.

شخص ما يدين لي بمبلغ كبير من المال، 51000 درهم إماراتي على وجه الدقة. لقد قمت بإعطائه مبلغ 60000 درهم إماراتي والتي كان سيقوم بسدادها بصورة شهرية على مدى 24 شهرًا.

ومع ذلك، بعد دفع 3 أشهر، توقف عن الدفع لي حتى الآن. أود الحصول على عرض أسعار حول تكلفة الحصول على مساعدة قانونية في مثل هذه الحالة.

Yes, we have an agreement, but it is through Whatsapp and it is in the Filipino language. I have a screenshot of the conversation but it is in Filipino.

So, is there any chance that I can claim the said amount with just a chat conversation?

I haven't heard from them since December 1, 2017, and I am afraid that they might run away.

You can approach a Filipino lawyer who will be able to read the message to ascertain if it meets the conditions of a Contract.

Whatsapp messages can be considered as a contract provided it fulfils the considerations of the Electronic Transaction Law.

You will have to present a proof of your claim, for example, services and materials supply contract, Invoices, proof of delivery of materials and services, emails or letters correspondences between you and the other person that you give for the loaned person.

We can start by sending IPTL, a formal legal notice, if they do not respond we can proceed with taking a formal legal action against them before the Dubai Civil Court.

Of course, we will have to see the contract to understand if you have chosen a different jurisdiction to regulate your relationship.
