Q: I am working in the HR department in one of the private companies for the last 12 years. Last week I received a redundancy letter from the HR manager terminating me for reducing people.
However, the actual reason is something else. I have sent an email to our company helpline on the HR manager and complained about him, and he came to know that I have sent an email to the senior manager.
It was only me who got this letter from the HR department. Now, they got a replacement for my position.
Can I file a complaint against the company in the labour court?
Please advise.

Obtaining a temporary work permit during a labour case

Q: Good afternoon,
How soon can I request a letter from Dubai Court to cancel my existing residence visa or issue a temporary visa if I have filed for a labour case against my employer?
The case is for the non-payment of my end of service benefits as I have an offer from another company and can't join them without cancellation from the Immigration and Labor Department.

Visa cancellation while a labour case is running in court
3
Q: Dear Sir/Ma’am,
I hope all is good with you and you will be able to help me in this situation.
I was working for a private company with which I have a labour court case ongoing for which the judgement is to be made on the 25th June.
I have received an offer letter from a free zone company which requires me to join on the 6th of June.
Could you please help me on how to get the cancellation of my visa done so the free zone company can proceed legally for me while my case is ongoing.
Thanking you,
Tanya

Terminating an employee's contract without notice and offering a reduced EoSB

0
Q: My company is registered under Tecom media city. They terminated me without proper notice and are asking me to agree on end of service benefits based on a reduced salary. I have never signed any contract for a reduced salary.
They also asked to sign a form in which it is written that all dues are cleared and they will pay me money over 9 months of equal installments. What should I do as I am in financial trouble? It's difficult to hire a full-time lawyer and stay without money in the UAE.
Can anyone help me to understand whether it is fruitful to fight against the employer and how much time it takes under COVID-19 circumstances?

Q: I resigned from a company and currently under notice period (1 month). I have a strong doubt that my employer will not pay my salary due & end of service benefits easily.
In this case, if I need to go to Dubai Court, normally, how much time it will take to get a judgment and my money in the present conditions?

Time frame from filing a labor case till receiving the due benefits
1
Q: Hi,
My labor case has been going on for 6 months now. The hearing started in Jul 2019. Dubai Court kept on conducting hearings until I received my first judgment in Nov 2019.
However, it was later changed to (For Investigation) and Adheed Centre advises that I must bring a witness to the court. I did bring a witness to the court during the hearing and the judge asked my witness questions and the other party witness as well.
The following hearing was in Dec 2019 and the judge pronounced another judgment schedule in Feb 2020. My demand was just my End of Service Benefits which is About AED 45,000.
My questions:
a) Why was not my first judgment in Nov 2019 executed instead of asking me to bring a witness?
b) Why does it take 6 months for my case?
c) Could this judgment in Feb 2020 be my final judgment?
d) If so, how long would it take to receive my End of Service benefits money?
Regards,

Can the employee cancel the visa while waiting a labor judgment of the supreme court?
1
Q: I filed a case against my employer in Apr-21 against arbitrary dismissal by them. I won the case in First Court and Second Court. Even the report from an expert appointed by the court was in my favor.
I filed for execution which was appealed by my employer, but they lost the appeal as well. In Jul-21, I obtained NOC from the court to work elsewhere (my wife’s company) and got 1-year Temporary Work Permit to work during this time.
The employer has further appealed to the Supreme Court in Apr-22. My questions are:
1. My visa is expiring in Jun-22 and I want to travel in Jul-22. I'm afraid the judgment may not come until then. I want to cancel my current visa and obtain another visa (under my wife's sponsorship as she holds the golden visa).
What is the procedure for cancellation, and will it have any adverse impact on my case or new visa application?
2. Will the employer be liable to pay the Execution Order amount as they have lost the appeal.
Thank you, Sir.

Bank filed a civil case over a loan: Better to settle with the bank or in court? 0
Good day, Sir,
I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019.
I cleared the cheque bounce case earlier with a court fine in 2019. I am looking forward to a minimum settlement plan with the bank. The outstanding amount was around 70,000 AED, and now the message is for 115,000 AED.
What will be the best way for me to proceed: approaching the bank or dealing with it in court?
Best regards,

Is it legal for my employer to withhold my salary until I leave the country or change status? 0
Hello,
I have given my notice, and my last day is July 24, but the employer is refusing to pay my salary; even the salary for June. Is this even legal?
He claims I'll get everything at once, which is after leaving the country or changing status.

Demanding that an employee pay for visa charges a year after resigning 0
Dear Lawyers,
I worked at a bakeshop here in Dubai. I resigned exactly one year ago. Now they want me to pay for visa charges, as stated in the offer letter.
If I cannot pay for the charges, my employer will claim financial loss due to the damages, estimated to be at least 7,000 AED.
What should I do about this? My monthly salary is only 2,800 AED.
